S.F. 311 Section 1. NEW SECTION . 279.72 Access to feminine hygiene 1 products —— restrooms. 2 The board of directors of a school district shall ensure that 3 feminine hygiene products can be accessed by students without 4 cost in at least half of the restrooms in school buildings in 5 the district where students in grades six through twelve are 6 educated and that the supply of feminine hygiene products is 7 refilled regularly. For purposes of this section, “feminine 8 hygiene products” means sanitary napkins, tampons, or other 9 similar items used for feminine hygiene. 10 Sec. 2. STATE MANDATE FUNDING SPECIFIED. In accordance 11 with section 25B.2, subsection 3, the state cost of requiring 12 compliance with any state mandate included in this Act shall 13 be paid by a school district from state school foundation aid 14 received by the school district under section 257.16. This 15 specification of the payment of the state cost shall be deemed 16 to meet all of the state funding-related requirements of 17 section 25B.2, subsection 3, and no additional state funding 18 shall be necessary for the full implementation of this Act 19 by and enforcement of this Act against all affected school 20 districts. 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 This bill requires school boards to ensure that feminine 25 hygiene products can be accessed by students without cost in at 26 least half of the restrooms in school buildings in the district 27 where students in grades 6 through 12 are educated and that the 28 supply of feminine hygiene products is refilled regularly. The 29 bill defines “feminine hygiene products” as sanitary napkins, 30 tampons, or other similar items used for feminine hygiene. 31 The bill may include a state mandate as defined in Code 32 section 25B.3. The bill requires that the state cost of 33 any state mandate included in the bill be paid by a school 34 district from state school foundation aid received by the 35 -1- LSB 2093XS (3) 88 je/jh 1/ 2
S.F. 311 school district under Code section 257.16. The specification 1 is deemed to constitute state compliance with any state mandate 2 funding-related requirements of Code section 25B.2.
