1.
Section
261.86,
subsection
6,
Code
2011,
is

amended
to
read
as
follows:

6.
Notwithstanding
section
8.33
,
until
one
year
after
the
3
date
the
president
of
the
United
States
or
the
Congress
of
4
the
United
States
declares
a
cessation
of
hostilities
ending
5
operation
Iraqi
freedom,
operation
new
dawn,
and
operation
6
enduring
freedom,
funds
appropriated
for
purposes
of
this
7
section
which
remain
unencumbered
or
unobligated
at
the
close
8
of
the
fiscal
year
for
which
the
funds
were
appropriated
shall
9
not
revert
but
shall
be
available
for
expenditure
for
the
10
following
fiscal
year
for
purposes
of
this
section
.

Sec.
2.
EFFECTIVE
UPON
ENACTMENT
AND
RETROACTIVE

APPLICABILITY.
This
Act,
being
deemed
of
immediate
importance,
13
takes
effect
upon
enactment
and
applies
retroactively
to
14
September
1,
2010.

EXPLANATION
16
This
bill
provides
that
funds
appropriated
for
the
national
17
guard
education
assistance
program
shall
not
revert
to
the
18
general
fund
of
the
state
but
shall
be
available
for
use
by
19
the
program
for
the
next
fiscal
year
until
one
year
after
the
20
declared
end
of
operation
Iraqi
freedom,
operation
new
dawn,
21
and
operation
enduring
freedom.
Operation
Iraqi
freedom
ended
22
on
August
31,
2010,
and
was
succeeded
by
operation
new
dawn
on
23
September
1,
2010.
The
bill
takes
effect
upon
enactment
and
24
applies
retroactively
to
September
1,
2010.
