Section
1.
Section
28E.23,
Code
2013,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
3.
If
a
city
in
the
district
has
a
3
population
of
less
than
one
thousand,
the
funds
annually
4
contributed
by
that
city
shall
not
exceed
the
actual
costs
of
5
providing
the
law
enforcement
services.
For
the
purposes
of
6
determining
the
population
of
a
city
under
this
subsection,
the
7
provisions
of
section
9F.6
shall
be
applied.

Sec.
2.
Section
331.304,
Code
2013,
is
amended
by
adding
the
9
following
new
subsection:

NEW
SUBSECTION
.
12.
A
county
shall
not
enter
into
an
11
agreement
to
provide
law
enforcement
services
to
a
city
with
12
a
population
of
less
than
one
thousand
that
requires
such
a
13
city
to
annually
pay
to
the
county
an
amount
exceeding
the
14
actual
costs
of
providing
the
law
enforcement
services.
For
15
the
purposes
of
determining
the
population
of
a
city
under
this
16
subsection,
the
provisions
of
section
9F.6
shall
be
applied.

Sec.
3.
APPLICABILITY.
This
Act
applies
to
agreements
18
entered
into
on
or
after
July
1,
2013.

EXPLANATION
20
This
bill
relates
to
agreements
for
the
provision
of
law
21
enforcement
services
by
a
county
sheriff
between
counties
22
and
cities
with
a
population
of
less
than
1,000
by
limiting
23
contribution
and
payment
rates.
The
bill
limits
contributions
24
of
funds
and
payment
rates
for
cities
with
a
population
of
25
less
than
1,000
that
are
participating
in
an
agreement
for
law
26
enforcement
services
or
in
a
unified
law
enforcement
district.
27
The
bill
limits
the
contribution
and
payment
rates
of
such
28
cities
to
no
more
than
the
actual
costs
of
providing
law
29
enforcement
services
to
those
cities.
The
provisions
of
Code
30
section
9F.6
shall
be
applied
in
determining
the
population
of
31
a
city.
32
The
bill
applies
to
agreements
entered
into
on
or
after
July
33
1,
2013.
