S.F. 269 Section 1. NEW SECTION . 92.24 Employer liability in 1 work-based learning. 2 1. For purposes of this section, unless the context 3 otherwise requires: 4 a. “Business” means any city, county, or township, including 5 but not limited to a fire department or law enforcement 6 office or department, public university, municipal university, 7 community college, technical college or not-for-profit 8 private postsecondary educational institution, corporation, 9 association, partnership, proprietorship, limited liability 10 company, limited partnership, limited liability partnership, 11 organization or other legal entity, whether for-profit or 12 not-for-profit, that does all of the following: 13 (1) Enters into an agreement with a school district for a 14 work-based learning program. 15 (2) Directly supervises a student who is participating in 16 the work-based learning program, either on the premises of the 17 business or at another location. 18 b. “Work-based learning program” means a learning program to 19 which all of the following apply: 20 (1) The program includes but is not limited to work-related, 21 on-the-job training, job shadowing, internships, clinicals, 22 practicums, registered apprenticeships, co-ops, supervised 23 agricultural experiences, and industry-led service-learning 24 projects. 25 (2) The program is incorporated into secondary coursework 26 or related to a specific field of study. 27 (3) The program integrates knowledge and theory learned 28 in the classroom or other school-approved setting with 29 the practical application and development of skills and 30 proficiencies in a professional work setting. 31 2. A business that accepts a secondary student in a 32 work-based learning program shall not be subject to civil 33 liability for any claim arising from the student’s negligent 34 act or omission during the student’s participation in the 35 -1- LSB 1695XS (3) 90 jda/jh 1/ 6
S.F. 269 work-based learning program on the premises of the business or 1 at another location. 2 3. A business that accepts a secondary student in a 3 work-based learning program shall not be subject to civil 4 liability for any claim for bodily injury to the student or 5 another person or sickness or death by accident of the student 6 arising from the student’s driving in between worksites or to 7 or from the premises of the business or another location to 8 participate in the work-based learning program. 9 4. A business that accepts a secondary student in a 10 work-based learning program shall not be subject to civil 11 liability for any claim for bodily injury to the student or 12 sickness or death by accident of the student arising from the 13 business’s negligent act or omission during the student’s 14 participation in the work-based learning program on the 15 premises of the business or at another location. 16 5. This section shall not be construed to provide immunity 17 for a student or business for civil liability arising from 18 gross negligence or willful misconduct stemming from a 19 work-based learning program. 20 Sec. 2. Section 256.11, subsection 5, paragraph h, Code 21 2023, is amended by adding the following new subparagraph: 22 NEW SUBPARAGRAPH . (04) Units of coursework that meet 23 the requirements of any combination of coursework required 24 under paragraph “a” , “b” , “d” , “e” , or “k” and incorporate the 25 curriculum required under subparagraph (1) shall be deemed to 26 satisfy the offer and teach requirements of this paragraph “h” 27 and a student who completes such units shall be deemed to have 28 met the graduation requirement of this paragraph “h” . 29 Sec. 3. NEW SECTION . 256.20 Career and technical education 30 teachers —— grant program. 31 1. The department shall establish a career and technical 32 education teachers grant program to provide grants to school 33 districts to supplement the wages of teachers providing 34 instruction pursuant to section 256.11, subsection 5, paragraph 35 -2- LSB 1695XS (3) 90 jda/jh 2/ 6
S.F. 269 “h” . 1 2. A school district may apply to the department for grants 2 under this section to supplement the wages of teachers employed 3 by the school district who provide instruction pursuant to 4 section 256.11, subsection 5, paragraph “h” . 5 3. Moneys awarded under this section shall be used to 6 supplement, not supplant, existing public funding used by a 7 school district for similar purposes. 8 4. A career and technical education teachers grant program 9 fund is established in the state treasury. The fund shall be 10 administered by the department and shall consist of moneys 11 appropriated by the general assembly and any other moneys 12 received by the department for deposit in the fund. The 13 moneys in the fund are appropriated to the department for 14 the career and technical education teachers grant program. 15 Notwithstanding section 8.33, moneys in the fund at the close 16 of the fiscal year shall not revert to the general fund of the 17 state but shall remain available for expenditure for the career 18 and technical education teachers grant program for subsequent 19 fiscal years. Notwithstanding section 12C.7, subsection 2, 20 interest or earnings on moneys in the fund shall be credited 21 to the fund. 22 5. The department shall develop a strategy for attracting 23 additional financial resources for the career and technical 24 education teachers grant program from other sources, which 25 may include the private sector and local, state, and federal 26 government funding sources. The financial resources received 27 shall be credited to the career and technical education 28 teachers grant program fund. 29 6. The state board shall adopt rules pursuant to chapter 17A 30 to administer this section, including rules related to grant 31 application materials, eligibility requirements, and award 32 criteria. 33 Sec. 4. DEPARTMENT OF EDUCATION —— SENIOR YEAR PLUS PROGRAM 34 —— TASK FORCE. 35 -3- LSB 1695XS (3) 90 jda/jh 3/ 6

The department of education shall convene and provide 1 administrative support to a senior year plus program task force 2 that shall study and make recommendations regarding all of the 3 following: 4 a. The supplementary weighting plan that applies to school 5 districts that send their resident high school pupils to a 6 community college for college-level classes, or to a class 7 taught by a community college-employed instructor, under the 8 district-to-community college sharing or concurrent enrollment 9 program established under section 261E.8. 10 b. The policies and procedures that apply to resident high 11 school pupils who are enrolled in a community college for 12 college-level classes under the district-to-community college 13 sharing or concurrent enrollment program established under 14 section 261E.8. 15 2. The task force shall include the following members: 16 a. A parent or guardian of a student who is participating 17 in the district-to-community college sharing or concurrent 18 enrollment program established under section 261E.8. 19 b. A student who is participating in the 20 district-to-community college sharing or concurrent enrollment 21 program established under section 261E.8. 22 c. A representative of a school district. 23 d. A representative of a community college. 24 e. A representative of the department of education. 25 3. The task force shall submit a report, including findings 26 and recommendations for policy changes, to the general assembly 27 by December 31, 2023. 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 This bill relates to education, including modifying 32 provisions relating to civil liability associated with 33 secondary students participating in work-based learning 34 programs and the career and technical education instruction 35 -4- LSB 1695XS (3) 90 jda/jh 4/ 6
S.F. 269 provided to students enrolled in grades 9 through 12 in 1 school districts and charter schools, establishing a career 2 and technical education teachers grant program within the 3 department of education (DE), and requiring DE to convene a 4 senior year plus program task force. 5 The bill provides that a business that accepts a secondary 6 student in a work-based learning program shall not be subject 7 to civil liability for any claim arising from the student’s 8 negligent act or omission during the student’s participation 9 in the program. The bill also provides that a business that 10 accepts a secondary student in a work-based learning program 11 shall not be subject to civil liability for any claim for 12 bodily injury to the student or another person or sickness or 13 death by accident of the student arising from the student’s 14 driving to participate in the program. Additionally, the bill 15 provides that a business that accepts a secondary student in 16 a work-based learning program shall not be subject to civil 17 liability for any claim for bodily injury to the student or 18 sickness or death by accident of the student arising from the 19 business’s negligent act or omission during the student’s 20 participation in the program. The bill establishes that these 21 provisions shall not be construed to provide immunity for a 22 student or business for civil liability arising from gross 23 negligence or willful misconduct stemming from a work-based 24 learning program. 25 The bill provides that units of coursework that meet the 26 requirements of the science, social studies, mathematics, or 27 personal financial literacy instruction, and that incorporate 28 the career and technical education curriculum, shall be deemed 29 to satisfy the requirements associated with the career and 30 technical education curriculum. 31 The bill establishes a career and technical education 32 teachers grant program within DE to provide grants to school 33 districts to supplement the wages of teachers providing career 34 and technical education instruction to students enrolled in 35 -5- LSB 1695XS (3) 90 jda/jh 5/ 6
S.F. 269 grades 9 through 12. The bill also establishes a career and 1 technical education teachers grant program fund in the state 2 treasury. The bill requires DE to develop a strategy for 3 attracting additional financial resources for the program 4 from other sources and provides that the additional financial 5 resources are to be credited to the fund. Additionally, the 6 bill requires the state board of education to adopt rules to 7 administer the program. 8 The bill requires DE to convene and provide administrative 9 support to a senior year plus program task force. The 10 bill establishes that the task force is to study and make 11 recommendations regarding the supplementary weighting 12 plan that applies to school districts that send their 13 resident high school pupils to a community college for 14 college-level classes, or to a class taught by a community 15 college-employed instructor, and the policies and procedures 16 that apply to resident high school pupils who are enrolled 17 in a community college for college-level classes under the 18 district-to-community college sharing or concurrent enrollment 19 program. The bill also establishes the membership of the task 20 force.
