S.F. 266 Section 1. Section 257.31, subsection 5, paragraph j, Code 1 2013, is amended to read as follows: 2 j. Unusual need to continue providing a program or other 3 special assistance to non-English speaking pupils after 4 the expiration of the four-year applicable period of years 5 specified in section 280.4 . 6 Sec. 2. Section 280.4, subsection 3, Code 2013, is amended 7 to read as follows: 8 3. a. In order to provide funds for the excess costs 9 of instruction of limited English proficient students above 10 the costs of instruction of pupils in a regular curriculum, 11 students identified as limited English proficient shall be 12 assigned an additional weighting of twenty-two hundredths, and 13 that weighting shall be included in the weighted enrollment of 14 the school district of residence for a period not exceeding 15 four the number of years specified in paragraph “b . However, 16 the school budget review committee may grant supplemental aid 17 or modified allowable growth to a school district to continue 18 funding a program for students after the expiration of the 19 four-year specified period of years in paragraph “b” . 20 b. (1) For students first determined to be limited English 21 proficient for a budget year beginning before July 1, 2013, 22 the additional weighting provided under paragraph “a” shall be 23 included in the weighted enrollment of the school district of 24 residence for a period not exceeding four years. 25 (2) For students first determined to be limited English 26 proficient for the budget year beginning July 1, 2013, the 27 additional weighting provided under paragraph “a” shall be 28 included in the weighted enrollment of the school district of 29 residence for a period not exceeding five years. 30 (3) For students first determined to be limited English 31 proficient for the budget year beginning July 1, 2014, the 32 additional weighting provided under paragraph “a” shall be 33 included in the weighted enrollment of the school district of 34 residence for a period not exceeding six years. 35 -1- LSB 2235XS (3) 85 md/sc 1/ 3
S.F. 266 (4) For students first determined to be limited English 1 proficient for a budget year beginning on or after July 1, 2 2015, the additional weighting provided under paragraph “a” 3 shall be included in the weighted enrollment of the school 4 district of residence for a period not exceeding seven years. 5 Sec. 3. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 6 immediate importance, takes effect upon enactment. 7 EXPLANATION 8 Current Code section 280.4 provides funds for the excess 9 costs of instruction of limited English proficient students 10 above the costs of instruction of pupils in a regular 11 curriculum. This funding is provided for a period not to 12 exceed four years through assignment of an additional weighting 13 of 22 hundredths to each student identified as limited English 14 proficient. 15 This bill increases the number of years for which a school 16 district of residence may include the additional weighting for 17 a student determined to be limited English proficient. Under 18 the bill, for students first determined to be limited English 19 proficient for a budget year beginning before July 1, 2013, 20 the additional weighting shall be included in the weighted 21 enrollment of the school district of residence for a period 22 not exceeding four years. For students first determined to 23 be limited English proficient for the budget year beginning 24 July 1, 2013, the additional weighting shall be included in the 25 weighted enrollment of the school district of residence for a 26 period not exceeding five years. For students first determined 27 to be limited English proficient for the budget year beginning 28 July 1, 2014, the additional weighting shall be included in the 29 weighted enrollment of the school district of residence for a 30 period not exceeding six years. For students first determined 31 to be limited English proficient for a budget year beginning 32 on or after July 1, 2015, the additional weighting shall be 33 included in the weighted enrollment of the school district of 34 residence for a period not exceeding seven years. 35 -2- LSB 2235XS (3) 85 md/sc 2/ 3
