S.F. 241 Section 1. Section 327F.13, subsection 2, Code 2023, is 1 amended to read as follows: 2 2. The warning device shall be placed in a location which 3 that is a reasonable distance from the close-clearance area and 4 that provides adequate notice to a person riding the side of a 5 train so that the person may prepare for the close clearance. 6 Any signs posted shall not be a danger to other persons working 7 on the property. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 Under current law, the owner of a railroad track is required 12 to place a warning device at a location where the close 13 clearance between the track and a building, machinery, trees, 14 brush, or other object is such that the building, machinery, 15 trees, brush, or other object physically impedes a person who 16 is lawfully riding the side of a train in the course of the 17 person’s duties in service to a railroad company from clearing 18 the building, machinery, trees, brush, or other object. The 19 warning device must be placed in a location which provides 20 adequate notice to a person riding the side of a train so that 21 the person may prepare for the close clearance. This bill 22 requires the warning device to also be placed a reasonable 23 distance from the close-clearance area. 24 By operation of law, a violation of the bill is a schedule 25 “one” penalty, a fine of $100 per violation. 26 -1- LSB 1909XS (2) 90 th/ns 1/ 1
