  4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 272.15, subsection 1, paragraph a,
  1  2 subparagraph (1), Code 2017, is amended by adding the following
  1  3 new subparagraph division:
  1  4    NEW SUBPARAGRAPH DIVISION.  (d)  Being on school premises
  1  5 or at a school=sponsored activity involving students while
  1  6 under the influence of, possessing, using, or consuming illegal
  1  7 drugs, prescription drugs as defined in section 155A.3 that are
  1  8 not prescribed for the licensed school employee's own use, or
  1  9 alcohol. The mere possession of prescription drugs prescribed
  1 10 for a member of the licensed school employee's household does
  1 11 not constitute reportable conduct under this paragraph "a".
  1 12                           EXPLANATION
  1 13 The inclusion of this explanation does not constitute agreement with
  1 14 the explanation's substance by the members of the general assembly.
  1 15    This bill adds to the list of disciplinary actions taken
  1 16 against a licensed school employee that are required under
  1 17 Code section 272.15 to be reported to the board of educational
  1 18 examiners.
  1 19    Currently, the boards of directors of school districts
  1 20 and area education agencies, the superintendent of a school
  1 21 district, the chief administrator of an area education agency,
  1 22 and the authorities in charge of an accredited nonpublic school
  1 23 must report to the board of educational examiners any instance
  1 24 of disciplinary action taken against a licensed school employee
  1 25 by such boards, administrators, and authorities, for certain
  1 26 conduct specified in the Code section. The bill adds to the
  1 27 list being on school premises or at a school=sponsored activity
  1 28 involving students while under the influence of, possessing,
  1 29 using, or consuming illegal drugs, prescription drugs that are
  1 30 not prescribed for the employee's own use, or alcohol. The
  1 31 mere possession of drugs prescribed for a household member,
  1 32 however, does not constitute reportable conduct.
