S.F. 2388 Section 1. Section 279.23, subsection 1, Code 2024, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . 0e. If the contract provides for one or 3 more severance payments, a statement that the administrator 4 shall not receive such payments if the contract is terminated 5 as a result of the administrator being found guilty in a 6 criminal proceeding on a charge relating to the administrator’s 7 official duties or a dereliction thereof for which the period 8 for appeal has passed, other than a proceeding regarding a 9 simple misdemeanor or a parking violation as defined in section 10 321.210. 11 Sec. 2. APPLICABILITY. This Act applies to contracts 12 entered into pursuant to section 279.23, or continued pursuant 13 to section 279.24, on or after the effective date of this Act. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill provides that if an employment contract between 18 a school board and an administrator provides for one or more 19 severance payments, the contract shall contain a statement 20 that the administrator shall not receive such payments if the 21 contract is terminated as a result of the administrator being 22 found guilty in a criminal proceeding on a charge relating 23 to the administrator’s official duties or a dereliction 24 thereof for which the period for appeal has passed, other 25 than a proceeding regarding a simple misdemeanor or a parking 26 violation. 27 The bill applies to contracts entered into or continued on or 28 after the effective date of the bill. 29 -1- LSB 5591SV (2) 90 je/jh 1/ 1
