  1  1    Section 1.  Section 17A.23, Code 2018, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  4.  An agency shall not implement or enforce
  1  4 any standard, requirement, or threshold, including any term
  1  5 or condition of a license issued by the agency, unless that
  1  6 standard, requirement, or threshold is explicitly required or
  1  7 explicitly permitted by a state statute, rule adopted pursuant
  1  8 to this chapter, or a federal statute or regulation.
  1  9                           EXPLANATION
  1 10 The inclusion of this explanation does not constitute agreement with
  1 11 the explanation's substance by the members of the general assembly.
  1 12    This bill modifies Code chapter 17A, the Iowa administrative
  1 13 procedure Act, by prohibiting a state agency from implementing
  1 14 or enforcing any standard, requirement, or threshold, including
  1 15 any term or condition of a license issued by the agency,
  1 16 unless that standard, requirement, or threshold is explicitly
  1 17 required or explicitly permitted by a state statute, rule
  1 18 adopted pursuant to Code chapter 17A, or a federal statute or
  1 19 regulation.
