NEW SECTION. 154G.1 Definitions. 1 2 As used in this chapter, unless the context otherwise 1 3 requires: 1 4 1. "Music therapist" means a person who holds one of the 1 5 following: 1 6 a. An active music therapist board=certified credential 1 7 granted by the certification board for music therapists. 1 8 b. A professional designation in good standing on the 1 9 national music therapy registry. 1 10 2. "Music therapy" means the clinical and evidence=based 1 11 use of music interventions to accomplish individualized goals 1 12 for people of all ages and ability levels within a therapeutic 1 13 relationship by a music therapist. 1 14 Sec. 2. NEW SECTION. 154G.2 Practice or use of title. 1 15 1. A person shall not profess to be a music therapist or 1 16 board=certified music therapist or use the initials "MT=BC" 1 17 or any other words, letters, abbreviations, or insignia 1 18 indicating or implying that the person is a music therapist 1 19 unless the person holds and maintains the music therapist 1 20 board=certified credential granted by the certification board 1 21 for music therapists or until January 20, 2020, is designated 1 22 as a registered music therapist, certified music therapist, or 1 23 advanced certified music therapist and is in good standing on 1 24 the national music therapy registry. 1 25 2. This chapter does not prohibit a person from using music 1 26 in the performance of the person's profession or occupation if 1 27 incidental to the person's profession or occupation and if the 1 28 person does not represent that the person is a music therapist. 1 29 3. A person who violates this section is guilty of a simple 1 30 misdemeanor. 1 31 EXPLANATION 1 32 The inclusion of this explanation does not constitute agreement with 1 33 the explanation's substance by the members of the general assembly. 1 34 This bill requires any person claiming to be a music 1 35 therapist to hold a music therapist board=certified credential 2 1 granted by the certification board for music therapists or 2 2 until January 20, 2020, is designated as a registered music 2 3 therapist, or advanced certified music therapist and is in good 2 4 standing on the national music therapy registry. A person who 2 5 violates this bill is guilty of a simple misdemeanor. A simple 2 6 misdemeanor is punishable by confinement for no more than 30 2 7 days or a fine of at least $65 but not more than $625 or by 2 8 both. LSB 5721SS (7) 87 ss/rh
