S.F. 2299 Section 1. Section 123A.5, subsection 1, paragraph b, Code 1 2024, is amended to read as follows: 2 b. Require a wholesaler to assent to any unreasonable 3 requirement, condition, understanding, or term of an agreement 4 prohibiting a wholesaler from selling the product of another 5 brewer , or prohibiting a wholesaler from utilizing, or 6 requiring a wholesaler to utilize, a business-to-business 7 electronic commerce platform offered by a brewer . If a 8 wholesaler does utilize a business-to-business electronic 9 commerce platform offered by a brewer, the brewer shall not 10 request or receive any information related to a class “A” or 11 special class “A” beer permittee’s sale of competitive products 12 on the business-to-business electronic commerce platform. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill prohibits a brewer from requiring a wholesaler 17 to assent to any unreasonable requirement, condition, 18 understanding, or term of an agreement prohibiting the 19 wholesaler from utilizing, or requiring the wholesaler 20 to utilize, a business-to-business electronic commerce 21 platform offered by a brewer. If a wholesaler utilizes a 22 business-to-business electronic commerce platform offered by 23 a brewer, the bill prohibits the brewer from requesting or 24 receiving any information related to a class “A” or special 25 class “A” beer permittee’s sale of competitive products on the 26 platform. A brewer that violates the provisions of the bill is 27 subject to civil action by the aggrieved party pursuant to Code 28 section 123A.9. 29 -1- LSB 5739SV (2) 90 nls/ns 1/ 1
