Section 157.1, Code 2016, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 24A. "Natural hair braiding" means a method 1 4 of natural hair care consisting of braiding, locking, twisting, 1 5 weaving, cornrowing, or otherwise physically manipulating hair 1 6 without the use of chemicals to alter the hair's physical 1 7 characteristics that incorporates both traditional and modern 1 8 styling techniques. 1 9 Sec. 2. Section 157.1, subsection 5, paragraph a, Code 2016, 1 10 is amended to read as follows: 1 11 a. Arranging, braiding, dressing, curling, waving, press 1 12 and curl hair straightening, shampooing, cutting, singeing, 1 13 bleaching, coloring, or similar works, upon the hair of any 1 14 person, or upon a wig or hairpiece when done in conjunction 1 15 with haircutting or hairstyling by any means. "Cosmetology" 1 16 does not include natural hair braiding. 1 17 Sec. 3. Section 157.2, Code 2016, is amended by adding the 1 18 following new subsection: 1 19 NEW SUBSECTION. 6. Persons performing natural hair 1 20 braiding shall pass a health and sanitation examination as 1 21 prescribed by the board and shall register with the board. 1 22 The registration information shall include an address and 1 23 description of the location or locations where the person 1 24 performs natural hair braiding. The department shall inspect 1 25 a location where a person performs natural hair braiding upon 1 26 receipt of a complaint to the board about that location. The 1 27 inspection shall monitor compliance with health and sanitation 1 28 requirements established under this chapter or by rule as 1 29 adopted by the board. A person who performs natural hair 1 30 braiding who is deemed to have failed an inspection by the 1 31 department shall pay a fine as determined by the board. 1 32 EXPLANATION 1 33 The inclusion of this explanation does not constitute agreement with 1 34 the explanation's substance by the members of the general assembly. 1 35 Generally, a person practicing cosmetology on a more than 2 1 casual basis, regardless of whether the person is compensated, 2 2 is required to be licensed with the board of cosmetology arts 2 3 and sciences. This bill defines "natural hair braiding" and 2 4 exempts it from the definition of cosmetology in Code chapter 2 5 157. 2 6 The bill requires persons performing natural hair braiding 2 7 to pass a health and sanitation examination as prescribed by 2 8 the board of cosmetology and to register with the board of 2 9 cosmetology. If the board of cosmetology receives a complaint 2 10 about a person performing natural hair braiding, the department 2 11 of public health shall inspect the location where the person 2 12 performs the natural hair braiding to monitor compliance with 2 13 the board of cosmetology's health and sanitation requirements 2 14 established under Code chapter 157 or as adopted by the board 2 15 of cosmetology by rule.
