1.
Section
321.436,
Code
2011,
is
amended
to
read
1
as
follows:

321.436
Mufflers,
prevention
of
noise.

1.
Every
motor
vehicle
shall
at
all
times
be
equipped
with
4
a
muffler
in
good
working
order
and
in
constant
operation
to
5
prevent
excessive
or
unusual
noise
and
annoying
smoke,
and
no
6
person
shall
use
a
muffler
cutout,
bypass
or
similar
device
7
upon
a
motor
vehicle
on
a
highway.

2.
A
motor
vehicle
shall
not
be
operated
on
a
highway
with
9
a
muffler
that
emits
a
noise
exceeding
ninety-five
decibels
as
10
measured
by
the
society
of
automotive
engineers
standard
J1169,
11
May
1998.
The
department
of
transportation
shall
adopt
rules
12
prescribing
the
appropriate
equipment
to
be
used
for
roadside
13
testing
of
muffler
noise.

3.
This
section
shall
be
implemented
uniformly
throughout
15
the
state
and
shall
preempt
any
county
or
municipal
ordinance
16
regulating
mufflers
on
motor
vehicles.

EXPLANATION
18
This
bill
establishes
a
noise
limit
for
motor
vehicle
19
mufflers
of
95
decibels
as
measured
by
society
of
automotive
20
engineers
standard
J1169,
May
1998.
The
standard
incorporates
21
noise
measurement
procedures
established
by
the
international
22
organization
for
standardization.
The
department
of
23
transportation
is
required
to
adopt
rules
prescribing
24
appropriate
equipment
to
be
used
for
roadside
testing
of
motor
25
vehicle
muffler
noise.
26
Pursuant
to
current
law,
a
violation
of
motor
vehicle
27
muffler
requirements
is
a
simple
misdemeanor
punishable
by
a
28
scheduled
fine
of
$20.
