  1  1    Section 1.  Section 901.2, subsection 2, paragraph d, Code
  1  2 2016, is amended by adding the following new subparagraph:
  1  3    NEW SUBPARAGRAPH.  (4)  A risk assessment when the offense
  1  4 is a domestic abuse assault in violation of section 708.2A, or
  1  5 harassment in violation of section 708.7.
  1  6    Sec. 2.  Section 901.3, Code 2016, is amended by adding the
  1  7 following new subsection:
  1  8    NEW SUBSECTION.  1A.  The performance of a risk assessment
  1  9 shall be required as part of a presentence investigation under
  1 10 subsection 1 for domestic abuse assault in violation of section
  1 11 708.2A, harassment in violation of section 708.7, or stalking
  1 12 in violation of section 708.11.
  1 13    Sec. 3.  NEW SECTION.  903A.8  Violent repeat offender.
  1 14    1.  A violent repeat offender is any person convicted of a
  1 15 felony offense under chapter 707, 708, 709, 710, 711, or 713,
  1 16 who has previously been convicted of any two felony violations
  1 17 under chapter 707, 708, 709, 710, 711, or 713.
  1 18    2.  Notwithstanding subsection 1, a person shall not be
  1 19 considered to be a violent repeat offender if the conviction
  1 20 that would otherwise make the offender a violent repeat
  1 21 offender is a conviction for murder in the second degree in
  1 22 violation of section 707.3, attempted murder in violation of
  1 23 section 707.11, sexual abuse in the second degree in violation
  1 24 of section 709.3, kidnapping in the second degree in violation
  1 25 of section 710.3, robbery in the first degree in violation of
  1 26 section 711.2, or robbery in the second degree in violation
  1 27 of section 711.3.  However, a  prior conviction for murder in
  1 28 the second degree in violation of section 707.3, attempted
  1 29 murder in violation of section 707.11, sexual abuse in the
  1 30 second degree in violation of section 709.3, kidnapping in the
  1 31 second degree in violation of section 710.3, robbery in the
  1 32 first degree in violation of section 711.2, or robbery in the
  1 33 second degree in violation of section 711.3 shall be counted
  1 34 as a previous conviction in determining whether a person is a
  1 35 violent repeat offender due to the most recent conviction.
  2  1    3.  An offense is a felony if, by the law under which the
  2  2 person is convicted, it is so classified at the time of the
  2  3 person's conviction.
  2  4    4.  For purposes of this section, felony conviction
  2  5 includes any felony conviction in another jurisdiction that is
  2  6 comparable to a felony listed in subsection 1 or any conviction
  2  7 under the prior laws of this state or another jurisdiction,
  2  8 that is comparable to a felony conviction listed in subsection
  2  9 1.
  2 10    Sec. 4.  Section 903A.2, subsection 1, paragraphs a and b,
  2 11 Code 2016, are amended to read as follows:
  2 12    a.  (1)  Category "A" sentences are those sentences which
  2 13 are not subject to a maximum accumulation of earned time of
  2 14 fifteen percent of the total sentence of confinement under
  2 15 section 902.12 and those sentences which are not violent
  2 16 repeat offender sentences under section 903A.8. To the extent
  2 17 provided in subsection 5, category "A" sentences also include
  2 18 life sentences imposed under section 902.1. An inmate of an
  2 19 institution under the control of the department of corrections
  2 20 who is serving a category "A" sentence is eligible for a
  2 21 reduction of sentence equal to one and two=tenths days for each
  2 22 day the inmate demonstrates good conduct and satisfactorily
  2 23 participates in any program or placement status identified by
  2 24 the director to earn the reduction. The programs include but
  2 25 are not limited to the following:
  2 26    (1)  (a)  Employment in the institution.
  2 27    (2)  (b)  Iowa state industries.
  2 28    (3)  (c)  An employment program established by the director.
  2 29    (4)  (d)  A treatment program established by the director.
  2 30    (5)  (e)  An inmate educational program approved by the
  2 31 director.
  2 32    (2)  (a)  However, an An inmate required to participate in
  2 33 a sex offender treatment program shall not be eligible for a
  2 34 reduction of sentence unless the inmate participates in and
  2 35 completes a sex offender treatment program established by the
  3  1 director.
  3  2    (b)  An inmate required to participate in a batterers'
  3  3 treatment program shall not be eligible for a reduction of
  3  4 sentence unless the inmate participates in and completes a
  3  5 batterers' treatment program established by the director.
  3  6    (3)  An inmate serving a category "A" sentence is eligible
  3  7 for an additional reduction of sentence of up to three hundred
  3  8 sixty=five days of the full term of the sentence of the inmate
  3  9 for exemplary acts. In accordance with section 903A.4, the
  3 10 director shall by policy identify what constitutes an exemplary
  3 11 act that may warrant an additional reduction of sentence.
  3 12    b.  Category "B" sentences are those sentences which are
  3 13 subject to a maximum accumulation of earned time of fifteen
  3 14 percent of the total sentence of confinement under section
  3 15 902.12 or which are violent repeat offender sentences under
  3 16 section 903A.8. An inmate of an institution under the control
  3 17 of the department of corrections who is serving a category
  3 18 "B" sentence is eligible for a reduction of sentence equal to
  3 19 fifteen eighty=fifths of a day for each day of good conduct by
  3 20 the inmate.
  3 21    Sec. 5.  NEW SECTION.  905.16  Electronic tracking and
  3 22 monitoring system ==== domestic abuse.
  3 23    A person placed on probation, parole, work release, special
  3 24 sentence, or any other type of conditional release for domestic
  3 25 abuse assault in violation of section 708.2A, harassment in
  3 26 violation of section 708.7, stalking in violation of section
  3 27 708.11, or for a violation of any other offense, may be
  3 28 supervised by an electronic tracking and monitoring system for
  3 29 a period of time to be determined by the court, in addition to
  3 30 any other conditions of supervision.
  3 31                           EXPLANATION
  3 32 The inclusion of this explanation does not constitute agreement with
  3 33 the explanation's substance by the members of the general assembly.
  3 34    This bill establishes a criminal penalty for a violent
  3 35 repeat offender and reduces earned time for offenders
  4  1 required to participate in batterers' education under certain
  4  2 circumstances, provides for risk assessments, and relates to
  4  3 electronic tracking and monitoring.
  4  4    If a presentence investigation is required prior
  4  5 to sentencing, the bill requires that the presentence
  4  6 investigation include a risk assessment of the offender, if the
  4  7 offender was convicted of domestic abuse assault in violation
  4  8 of Code section 708.2A, harassment in violation of Code section
  4  9 708.7, or stalking in violation of Code section 708.11.
  4 10    The bill specifies that an offender placed on probation,
  4 11 parole, or work release, or any other type of conditional
  4 12 release for domestic abuse assault in violation of Code section
  4 13 708.2A, harassment in violation of Code section 708.7, stalking
  4 14 in violation of Code section 708.11, or for a violation of any
  4 15 other type offense, may be supervised by an electronic tracking
  4 16 and monitoring system for a period of time to be determined by
  4 17 the court.
  4 18    Under the bill, a violent repeat offender is any person
  4 19 convicted of a more serious felony under Code chapter
  4 20 707 (homicide), 708 (assault), 709 (sexual abuse), 710
  4 21 (kidnapping), 711 (robbery and extortion), or 713 (burglary)
  4 22 who has twice before been convicted of any felony violation
  4 23 under those Code chapters.
  4 24    An offender who is serving a violent repeat offender
  4 25 sentence under the bill is only eligible for a reduction of
  4 26 sentence equal to fifteen eighty=fifths of a day for each
  4 27 day of good conduct by the offender. Most other offenders
  4 28 are eligible for a reduction of sentence equal to one and
  4 29 two=tenths days for each day the inmate demonstrates good
  4 30 conduct.  The fifteen eighty=fifths of a day for each day
  4 31 of good conduct by a repeat violent offender equals the same
  4 32 rate of reduction of sentence for an offender who is serving
  4 33 a 70 percent sentence under Code section 902.12. However, an
  4 34 offender serving a violent repeat offender sentence is not
  4 35 required to serve seven=tenths of the maximum term of the
  5  1 sentence prior to being eligible for parole or work release as
  5  2 an offender serving a 70 percent sentence is required to serve.
  5  3    In order to preserve the service of a 70 percent sentence by
  5  4 an offender, a person shall not be a violent repeat offender
  5  5 if the most recent conviction that would otherwise make the
  5  6 offender a violent repeat offender is a conviction for murder
  5  7 in the second degree in violation of Code section 707.3,
  5  8 attempted murder in violation of Code section 707.11, sexual
  5  9 abuse in the second degree in violation of Code section 709.3,
  5 10 kidnapping in the second degree in violation of Code section
  5 11 710.3, robbery in the first degree in violation of Code section
  5 12 711.2, or robbery in the second degree in violation of Code
  5 13 section 711.3. However, a prior conviction for murder in the
  5 14 second degree, attempted murder, sexual abuse in the second
  5 15 degree, kidnapping in the second degree, robbery in the first
  5 16 degree, or robbery in the second degree shall be counted as
  5 17 a previous conviction in determining whether a person is a
  5 18 violent repeat offender.
  5 19    The bill provides that an inmate at a correctional
  5 20 institution who is required to participate in a batterers'
  5 21 education program is not eligible for a reduction of sentence
  5 22 under Code section 903A.2(1)(a) unless the inmate participates
  5 23 in and completes the batterers' education program established
  5 24 by the director of the department of corrections.
