  1 An Act relating to the procedures for transferring title of an
  2    abandoned property to a city.
  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 657A.10A, subsection 6, Code 2018, is
  1  2 amended to read as follows:
  1  3    6.  If a city files a petition under subsection 1, naming the
  1  4 holder of a tax sale certificate of purchase for the property
  1  5 as a respondent, the city shall also file the petition,
  1  6 along with a verified statement declaring that the property
  1  7 identified in the petition contains an abandoned building,
  1  8 with the county treasurer. Upon receiving the petition and
  1  9 verified statement, If title is awarded to the city, the city
  1 10 shall notify the county treasurer, who shall make an entry in
  1 11 the county system canceling the sale of the property and shall
  1 12 refund the purchase money to the tax sale certificate holder.
  1 13                           EXPLANATION
  1 14 The inclusion of this explanation does not constitute agreement with
  1 15 the explanation's substance by the members of the general assembly.
  1 16    Currently, when a city in which an abandoned building is
  1 17 located petitions the court to enter a judgment awarding title
  1 18 of an abandoned property to the city, the city must file its
  1 19 petition and a verified statement declaring that the property
  1 20 has an abandoned building with the county treasurer. Upon this
  1 21 filing, the county treasurer enters a cancellation of the sale
  1 22 of the property and refunds the purchase money to the tax sale
  1 23 certificate holder. Under this bill, the county treasurer
  1 24 instead cancels the sale and makes the refund when the title to
  1 25 the property is awarded to the city. The bill requires a city
  1 26 to notify the county treasurer of such an award.
