Senate File 2195 - Introduced SENATE FILE BY SCHULTZ A BILL FOR 1 An Act relating to the corroboration of certain evidence 2 provided in a termination of parental rights proceeding. 3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 6099XS (2) 87 pf/jh PAG LIN 1 1 Section 1. Section 232.116, Code 2018, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 2A. In considering whether to terminate 1 4 the rights of a parent under this section when the grounds are 1 5 based on the child having been adjudicated a child in need of 1 6 assistance under section 232.96, any report or statement made 1 7 or evidence provided to the court by the department of human 1 8 services shall be corroborated by additional evidence provided 1 9 by an independent source and shall not alone be sufficient to 1 10 sustain the petition for termination of parental rights. 1 11 EXPLANATION 1 12 The inclusion of this explanation does not constitute agreement with 1 13 the explanation's substance by the members of the general assembly. 1 14 This bill relates to the termination of the parent=child 1 15 relationship under Code chapter 232 (juvenile justice) 1 16 relating to a child who has been adjudicated a child in need 1 17 of assistance. The bill provides that in considering whether 1 18 to terminate the rights of a parent when the grounds for 1 19 termination are based on the child having been adjudicated 1 20 a child in need of assistance, any report or statement made 1 21 or evidence provided to the court by the department of human 1 22 services shall be corroborated by additional evidence provided 1 23 by an independent source and shall not alone be sufficient to 1 24 sustain the petition for termination of parental rights.
