  1  1    Section 1.  Section 321.438, subsection 2, Code 2018, is
  1  2 amended to read as follows:
  1  3    2.  a.  A person shall not operate on the highway a motor
  1  4 vehicle equipped with a front windshield, a side window to the
  1  5 immediate right or left of the driver, or a side=wing sidewing
  1  6  forward of and to the left or right of the driver which is
  1  7 excessively dark or reflective so that it is difficult for a
  1  8 person outside the motor vehicle to see into the motor vehicle
  1  9 through the windshield, window, or sidewing.
  1 10    b.  A person shall not sell a motor vehicle equipped with
  1 11 a front windshield, a side window to the immediate right or
  1 12 left of the driver, or a sidewing forward of and to the left or
  1 13 right of the driver which is excessively dark or reflective so
  1 14 that it is difficult for a person outside the motor vehicle to
  1 15 see into the motor vehicle through the windshield, window, or
  1 16 sidewing.
  1 17    c.  A person shall not install in a motor vehicle a front
  1 18 windshield, a side window to the immediate right or left of the
  1 19 driver, or a sidewing forward of and to the left or right of the
  1 20 driver which is excessively dark or reflective so that it is
  1 21 difficult for a person outside the motor vehicle to see into
  1 22 the motor vehicle through the windshield, window, or sidewing.
  1 23    d.  The department shall adopt rules establishing a minimum
  1 24 measurable standard of transparency which shall apply to
  1 25 violations of this subsection.
  1 26                           EXPLANATION
  1 27 The inclusion of this explanation does not constitute agreement with
  1 28 the explanation's substance by the members of the general assembly.
  1 29    Under current law, a person is prohibited from operating on
  1 30 the highway a motor vehicle equipped with a front windshield,
  1 31 a side window to the immediate right or left of the driver, or
  1 32 a sidewing forward of and to the left or right of the driver
  1 33 which is excessively dark or reflective so that it is difficult
  1 34 for a person outside the vehicle to see into the vehicle
  1 35 through the windshield, window, or sidewing. Under rules
  2  1 adopted by the department of transportation, "excessively dark
  2  2 or reflective" means that the windshield, front side window, or
  2  3 front sidewing does not meet a minimum standard of transparency
  2  4 of 70 percent light transmittance.
  2  5    This bill prohibits a person from selling a motor vehicle
  2  6 equipped with a front windshield, a side window to the
  2  7 immediate right or left of the driver, or a sidewing forward
  2  8 of and to the left or right of the driver which is excessively
  2  9 dark or reflective. The bill also prohibits a person from
  2 10 installing in a motor vehicle a front windshield, a side
  2 11 window to the immediate right or left of the driver, or a
  2 12 sidewing forward of and to the left or right of the driver
  2 13 which is excessively dark or reflective. By operation of law,
  2 14 a violation of these provisions is punishable by a scheduled
  2 15 fine of $50.
