IT
ENACTED
BY
THE
GENERAL
ASSEMBLY
OF
THE
STATE
OF
IOWA:
Section
1.
Section
249A.38,
subsection
1,
unnumbered
paragraph
1,
Code
Supplement
2011,
is
amended
to
read
as
follows:
The
following
conditions
shall
apply
to
an
individual
who
is
an
inmate
of
a
public
institution
as
defined
in
42
C.F.R.
§
435.1010,
who
is
enrolled
in
the
medical
assistance
program
at
the
time
of
commitment
to
the
public
institution,
and
who

remains
eligible
for
medical
assistance
by
reason
of
disability
or
being
sixty-five
years
of
age
or
older
as
an
individual
except
for
the
individual’s
institutional
status
