Section
1.
Section
237.3,
Code
2020,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION

11.
Rules
of
the
department
shall
not
deny
3
licensure
to
or
otherwise
discriminate
against
a
foster
home,
4
as
defined
in
section
237.13,
based
on
the
immunization
status
5
of
the
individual
or
the
individual’s
children.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
8
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
rules
adopted
by
the
department
of
human
10
services
from
denying
licensure
to
or
otherwise
discriminating
11
against
a
foster
home
based
on
the
immunization
status
of
the
12
individual
or
the
individual’s
children.
For
the
purposes
13
of
the
bill,
“foster
home”
is
defined
as
an
individual
who
14
is
licensed
to
provide
child
foster
care;
and
“individual”
15
is
defined
as
an
individual
person
or
a
married
couple
who
16
provides
child
foster
care
in
a
single-family
home
environment
17
and
which
does
not
meet
the
definition
of
an
agency.
