The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the

Current
law
allows
the
operation
of
all-terrain
vehicles
22
on
secondary
roads
under
certain
conditions.
Under
Code
23
sections
321.234A
and
321I.10(2),
an
all-terrain
or
off-road
24
utility
vehicle
may
be
operated
on
portions
of
secondary
roads
25
designated
by
the
county
board
of
supervisors
for
such
use
26
during
a
specified
time.
27
This
bill
provides
that
all-terrain
vehicles
may
be
operated
28
on
secondary
roads
at
all
times
without
a
designation
by
the
29
county
board
of
supervisors.
A
person
operating
an
all-terrain
30
vehicle
on
a
highway
must
have
a
valid
driver’s
license
and
the
31
all-terrain
vehicle
must
be
operated
at
a
speed
of
35
miles
per
32
hour
or
less.
The
definition
of
“all-terrain
vehicle”
in
Code
33
section
321.1(4)
includes
off-road
utility
vehicles.
Operating
34
an
all-terrain
vehicle
or
off-road
utility
vehicle
in
violation

these
requirements
is
punishable
by
a
scheduled
fine
of
$50.

Pursuant
to
Code
section
321I.13,
an
all-terrain
vehicle

operated
during
the
hours
of
darkness
must
display
a
lighted
3
headlight
and
taillight.
For
purposes
of
Code
chapter
321I,
4
an
operator
of
an
off-road
utility
vehicle
is
subject
to
5
the
same
provisions
governing
the
operation
of
all-terrain
6
vehicles.
Operating
an
all-terrain
or
off-road
utility
vehicle
7
in
violation
of
this
requirement
is
punishable
by
a
scheduled
8
fine
of
$20.

The
bill
makes
a
conforming
change
to
Code
section
10
321I.10(5)(e).
