S.F. 2158 Section 1. Section 321.234A, subsection 1, paragraph f, 1 Code 2020, is amended to read as follows: 2 f. The all-terrain vehicle is operated on a county roadway 3 in accordance with section 321I.10, subsection 2 , or a city 4 street in accordance with section 321I.10, subsection 3 . 5 Sec. 2. Section 321.234A, subsection 1, Code 2020, is 6 amended by adding the following new paragraph: 7 NEW PARAGRAPH . h. The all-terrain vehicle is operated on 8 a secondary road. 9 Sec. 3. Section 321I.10, subsection 2, Code 2020, is amended 10 by striking the subsection. 11 Sec. 4. Section 321I.10, subsection 5, paragraph e, Code 12 2020, is amended to read as follows: 13 e. The crossing is made from a street, roadway, or highway 14 designated as an all-terrain vehicle trail by a state agency , 15 county, or city , or from a secondary road, to a street, 16 roadway, or highway designated as an all-terrain vehicle trail 17 by a state agency , county, or city , or to a secondary road . 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 Current law allows the operation of all-terrain vehicles 22 on secondary roads under certain conditions. Under Code 23 sections 321.234A and 321I.10(2), an all-terrain or off-road 24 utility vehicle may be operated on portions of secondary roads 25 designated by the county board of supervisors for such use 26 during a specified time. 27 This bill provides that all-terrain vehicles may be operated 28 on secondary roads at all times without a designation by the 29 county board of supervisors. A person operating an all-terrain 30 vehicle on a highway must have a valid driver’s license and the 31 all-terrain vehicle must be operated at a speed of 35 miles per 32 hour or less. The definition of “all-terrain vehicle” in Code 33 section 321.1(4) includes off-road utility vehicles. S.F. 2158 of these requirements is punishable by a scheduled fine of $50. 1 Pursuant to Code section 321I.13, an all-terrain vehicle 2 operated during the hours of darkness must display a lighted 3 headlight and taillight. For purposes of Code chapter 321I, 4 an operator of an off-road utility vehicle is subject to 5 the same provisions governing the operation of all-terrain 6 vehicles. Operating an all-terrain or off-road utility vehicle 7 in violation of this requirement is punishable by a scheduled 8 fine of $20. 9 The bill makes a conforming change to Code section 10 321I.10(5)(e). 11 -2- LSB 5884XS (4) 88 mo/ns 2/ 2
