S.F. 2157 Section 1. Section 709.21, subsection 1, Code 2020, is 1 amended to read as follows: 2 1. A person who knowingly views, photographs, or films 3 another person , for the purpose of arousing or gratifying the 4 sexual desire of any person, commits invasion of privacy if all 5 of the following apply: 6 a. The other person does not consent or is unable to consent 7 to being viewed, photographed, or filmed. 8 b. The other person is in a state of full or partial nudity. 9 c. The other person has a reasonable expectation of privacy 10 while in a state of full or partial nudity. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 Under current law, to be guilty of invasion of privacy, a 15 person must knowingly view, photograph, or film another person 16 for the purpose of arousing or gratifying the sexual desire 17 of any person, if the other person does not consent or is 18 unable to consent to being viewed, photographed, or filmed; the 19 other person is in a state of full or partial nudity; and the 20 other person has a reasonable expectation of privacy while in 21 a state of full or partial nudity. This bill eliminates the 22 requirement that the person act for the purpose of arousing or 23 gratifying the sexual desire of any person. 24 A person found guilty of invasion of privacy is, upon 25 conviction, guilty of an aggravated misdemeanor. An aggravated 26 misdemeanor is punishable by confinement for no more than two 27 years and a fine of at least $625 but not more than $6,250.
