  1  1    Section 1.  HAWK=I COVERED SPEECH THERAPY BENEFIT.  The
  1  2 hawk=i covered speech therapy benefit shall provide for
  1  3 coverage of both habilitative and rehabilitative services
  1  4 for children with speech, language, and hearing disorders as
  1  5 medically necessary. The determination that a service is
  1  6 medically necessary shall not be interpreted to require loss
  1  7 or impairment as the result of a stroke, accidental injury, or
  1  8 surgery to the head or neck as a prerequisite to coverage of
  1  9 services.
  1 10    Sec. 2.  HAWK=I BOARD DUTIES == BENEFIT PACKAGE.  The
  1 11 hawk=i board shall review the benefit package design of, the
  1 12 noninclusive list of benefits for, and the definition of
  1 13 medically necessary utilized under the hawk=i program, and
  1 14 shall approve a benefit package and adopt rules, pursuant to
  1 15 the duties specified in section 514I.5, to provide benefits
  1 16 uniformly and consistently across all participating insurers,
  1 17 in the type and manner that reflects and meets the needs of the
  1 18 child population, including children with special health care
  1 19 needs, under the hawk=i program.
  1 20    Sec. 3.  EFFECTIVE UPON ENACTMENT.  This Act, being deemed of
  1 21 immediate importance, takes effect upon enactment.
  1 22    Sec. 4.  RETROACTIVE APPLICABILITY.  This Act applies
  1 23 retroactively to March 1, 2016.
