S.F. 2116 Section 1. NEW SECTION . 17A.6C Agency fees —— periodic 1 comprehensive review. 2 1. For the three-year period beginning July 1, 2020, and 3 each three-year period thereafter, each agency shall conduct an 4 ongoing and comprehensive review of all fees, established by 5 rule or statute, imposed by the agency on the public. The goal 6 of the review is to ensure that the fees paid are sufficient to 7 meet the needs of the agency and the public. 8 2. a. By December 15 of each calendar year in which a 9 review of fees is completed by an agency as provided by this 10 section, the agency shall file a written report with the 11 general assembly which shall include the results of the review 12 and recommendations for changes, if any, concerning the fees. 13 A copy of the written report shall also be provided to the 14 administrative rules coordinator and the administrative rules 15 review committee. 16 b. If an agency has authority to increase the fee imposed 17 by rule, any fee increase proposed by rule shall not take 18 effect until on or after December 15 of the year succeeding 19 the written report reviewing the fee and the fee shall not be 20 increased in any calendar year in an amount that exceeds five 21 percent. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 This bill provides that for the three-year period beginning 26 July 1, 2020, and each three-year period thereafter, state 27 agencies shall conduct an ongoing and comprehensive review of 28 all fees, established by rule or statute, imposed by the agency 29 on the public. S.F. 2116 administrative rules review committee concerning the agency’s 1 review and recommendations for changes, if any, concerning 2 the fees.
