  1  1    Section 1.  Section 670.4, subsection 1, paragraph k, Code
  1  2 2018, is amended to read as follows:
  1  3    k.  A claim based upon or arising out of an act or omission
  1  4 of a municipality in connection with an emergency response
  1  5 including but not limited to acts or omissions in connection
  1  6 with emergency response communications services.  For the
  1  7 purposes of this paragraph, "municipality" includes a nonprofit
  1  8 corporation that delivers such emergency response services on
  1  9 behalf of a city, county, township, or benefited fire district
  1 10 pursuant to a written contract. The city, county, township,
  1 11 or benefited fire district shall file the written contract and
  1 12 any amendment, modification, or notice of termination of the
  1 13 contract in an electronic format with the secretary of state
  1 14 within thirty days of the effective date of the contract,
  1 15 amendment, modification, or termination in a manner specified
  1 16 by the secretary of state.

  1 18 The inclusion of this explanation does not constitute agreement with
  1 19 the explanation's substance by the members of the general assembly.
  1 20    This bill extends the immunity from tort liability, absent
  1 21 an express statute, granted to municipalities for claims
  1 22 based upon or arising out of an act or omission in connection
  1 23 with emergency response services to nonprofit corporations
  1 24 providing the same services pursuant to a written contract with
  1 25 a city, county, township, or benefited fire district. Any such
  1 26 contract and any modifications thereto shall be filed with the
  1 27 secretary of state within 30 days of their effectiveness.
