S.F. 2087 Section 1. NEW SECTION . 256.34 Creating outstanding 1 instructional leaders pilot program. 2 1. For each fiscal year of the fiscal period beginning July 3 1, 2012, and ending June 30, 2015, there is appropriated from 4 the general fund of the state to the department the sum of two 5 million five hundred thousand dollars to establish the creating 6 outstanding instructional leaders pilot program to promote 7 excellence in the teaching profession. The department shall 8 distribute the funds in the following manner each fiscal year: 9 a. The thirty school districts in the state with the highest 10 student population shall receive sufficient funds to provide 11 for three peer coaching stipends in accordance with this 12 section. 13 b. The seventy school districts in the state with the 14 thirty-first through one hundredth highest student population 15 shall receive sufficient funds to provide for two peer coaching 16 stipends in accordance with this section. 17 c. The remaining funds shall be allocated to the area 18 education agencies in proportion to the number of students 19 in the school districts in the area education agencies which 20 did not receive funds pursuant to paragraph “a” or “b” . The 21 funds shall be used to provide for peer coaching stipends in 22 accordance with this section for such school districts. The 23 area education agencies shall establish an application process 24 for such districts seeking funds for peer coaching stipends. 25 2. A school district receiving funds shall use such funds 26 to establish yearly peer coaching stipends for teachers in the 27 amount of eight thousand dollars. A school district shall use 28 the funds in the school year in which they are received and 29 shall only use the funds for the purposes provided in this 30 section. Stipends shall be awarded by the board of directors 31 in charge of a school district and shall only be awarded to 32 teachers who volunteer for the program. 33 3. A teacher receiving a peer coaching stipend shall, in 34 lieu of the teacher’s daily preparation activities during the 35 -1- LSB 5676XS (5) 84 je/rj 1/ 5
S.F. 2087 school day, engage in peer coaching in accordance with this 1 section. The board of directors in charge of a school district 2 shall assign peer coaches to teachers in need of additional 3 guidance in one or more aspects of the teaching profession. 4 Assignments shall be based on either a request from a principal 5 or from an individual teacher upon approval of a principal. 6 A peer coach shall still be responsible for completing daily 7 preparation activities outside of the school day. 8 4. Peer coaching shall include detailed preliminary 9 discussions as to areas in which the teacher being coached 10 desires to improve; formulation of an action plan to bring 11 about such improvement; in-class supervision by the peer coach; 12 postclass discussion of strengths, weaknesses, and strategies 13 for improvement; dialogue between the peer coach and students 14 and school officials regarding the teacher being coached; and 15 documentation of progress of the peer coaching. 16 5. The department shall establish by rule evaluation 17 criteria for determining the success of the creating 18 outstanding instructional leaders pilot program and of 19 individual peer coaches. Peer coaches whom the department does 20 not find effective shall not be awarded a peer coaching stipend 21 in succeeding years. 22 6. The department shall submit to the general assembly 23 by January 1, annually, a report on the creating outstanding 24 instructional leaders pilot program. The report shall include 25 the number of peer coaching stipends awarded and to which 26 school districts, identifiable outcomes of the program, and 27 other pertinent information. 28 7. This section is repealed June 30, 2015. 29 Sec. 2. IMPLEMENTATION OF ACT. The appropriation made 30 in this Act is intended to cover the costs of any state 31 mandate included in this Act and this specification of state 32 funding shall be deemed to meet all the state funding-related 33 requirements of section 25B.2, subsection 3, and no additional 34 state funding shall be necessary for the full implementation of 35 -2- LSB 5676XS (5) 84 je/rj 2/ 5
S.F. 2087 this Act by, and enforcement of this Act against, all affected 1 political subdivisions. 2 EXPLANATION 3 This bill establishes the creating outstanding instructional 4 leaders (COIL) pilot program to promote excellence in the 5 teaching profession. The bill appropriates annually for the 6 2012-2013, 2013-2014, and 2014-2015 fiscal years, $2,500,000 7 from the general fund of the state to the department of 8 education to establish the program. The bill requires a school 9 district receiving funds under the bill to use the funds to 10 establish yearly peer coaching stipends for teachers in the 11 amount of $8,000. The bill provides that a school district 12 receiving funds under the bill must use the funds in the school 13 year in which they are received and must only use the funds for 14 the purposes provided in the bill. Stipends are to be awarded 15 by the board of directors in charge of a school district and 16 can only be awarded to teachers who volunteer for the program. 17 The bill requires the department of education to distribute 18 the funds appropriated in the bill in a certain manner. The 19 bill provides that the 30 school districts in the state with 20 the highest student population shall receive sufficient funds 21 to provide for three peer coaching stipends in accordance with 22 the bill. The bill provides that the 70 school districts 23 in the state with the 31st through 100th highest student 24 population shall receive sufficient funds to provide for two 25 peer coaching stipends in accordance with the bill. The 26 bill provides that the remaining funds shall be allocated to 27 the area education agencies in proportion to the number of 28 students in school districts which did not otherwise receive 29 funds pursuant to the bill. The funds shall be used to provide 30 for peer coaching stipends in accordance with the bill for 31 such school districts. The bill requires the area education 32 agencies to establish an application process for such districts 33 seeking funds for peer coaching stipends. 34 The bill provides that a teacher receiving a peer coaching 35 -3- LSB 5676XS (5) 84 je/rj 3/ 5

A peer 7 coach is still responsible for completing daily preparation 8 activities outside of the school day. 9 The bill defines certain mandatory peer coaching activities, 10 including detailed preliminary discussions as to areas in which 11 the teacher being coached desires to improve; formulation 12 of an action plan to bring about such improvement; in-class 13 supervision by the peer coach; postclass discussion of 14 strengths, weaknesses, and strategies for improvement; dialogue 15 between the peer coach and students and school officials 16 regarding the teacher being coached; and documentation of 17 progress of the peer coaching. 18 The bill directs the department of education to establish 19 by rule evaluation criteria for determining the success of 20 the COIL pilot program and of individual peer coaches. The 21 bill provides that peer coaches whom the department does not 22 find effective shall not be awarded a peer coaching stipend in 23 succeeding years. 24 The bill also directs the department to submit to the 25 general assembly by January 1, annually, a report on the COIL 26 pilot program, which shall include the number of peer coaching 27 stipends awarded and to which school districts, identifiable 28 outcomes of the program, and other pertinent information. 29 The COIL pilot program is repealed June 30, 2015. 30 The bill may include a state mandate as defined in Code 31 section 25B.3. The bill provides that the appropriation made 32 in the bill is intended to cover the costs of any state mandate 33 included in the bill. The inclusion of this specification 34 of state funding is intended to reinstate the requirement 35 -4- LSB 5676XS (5) 84 je/rj 4/ 5
