Senate File 2083 - Introduced SENATE FILE BY KINNEY A BILL FOR 1 An Act relating to the limitations on criminal actions for the 2 criminal offense of child endangerment. 3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 5934XS (3) 86 jm/nh PAG LIN 1 1 Section 1. Section 802.2B, Code 2016, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 5A. Child endangerment in violation of 1 4 section 726.6. 1 5 EXPLANATION 1 6 The inclusion of this explanation does not constitute agreement with 1 7 the explanation's substance by the members of the general assembly. 1 8 This bill relates to the limitations on criminal actions for 1 9 the criminal offense of child endangerment. 1 10 Under the bill, an information or indictment for child 1 11 endangerment in violation of Code section 726.6 committed on or 1 12 with a person who is a child under the age of 14 or who is under 1 13 the age of 18 and who has a mental or physical disability, 1 14 shall be found within 10 years after the person upon whom the 1 15 offense is committed attains 18 years of age. 1 16 Current law provides that an indictment or information 1 17 shall be found within three years after its commission. The 1 18 punishment for child endangerment ranges from a class "B" 1 19 felony to an aggravated misdemeanor depending on the facts of 1 20 the case. 1 21 The bill also provides that if the person against whom the 1 22 information or indictment for child endangerment is sought is 1 23 identified through the use of a DNA profile, an information 1 24 or indictment shall be found within 10 years after the person 1 25 upon whom the offense was committed attains 18 years of age, or 1 26 within three years from the date the person is identified by 1 27 the person's DNA profile, whichever is later.
