Senate File 208 - Introduced SENATE FILE BY HORN and BERTRAND A BILL FOR 1 An Act concerning local ordinances regulating access to wine, 2 beer, and liquor control licensed establishments by any 3 person nineteen years of age or older. 4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 2196XS (2) 86 ec/nh PAG LIN 1 1 Section 1. Section 123.39, subsection 2, Code 2015, is 1 2 amended to read as follows: 1 3 2. Local authorities may suspend any retail wine or 1 4 beer permit or liquor control license for a violation of 1 5 any ordinance or regulation adopted by the local authority. 1 6 Local authorities may adopt ordinances or regulations for the 1 7 location of the premises of retail wine or beer and liquor 1 8 control licensed establishments and local authorities may adopt 1 9 ordinances, not in conflict with this chapter and that do 1 10 not diminish the hours during which beer, wine, or alcoholic 1 11 beverages may be sold or consumed at retail, governing any 1 12 other activities or matters which may affect the retail sale 1 13 and consumption of beer, wine, and alcoholic liquor and the 1 14 health, welfare and morals of the community involved. However, 1 15 local authorities shall not adopt ordinances or regulations 1 16 restricting access to the premises of any wine or beer and 1 17 liquor control licensed establishment to any person nineteen 1 18 years of age or older. 1 19 EXPLANATION 1 20 The inclusion of this explanation does not constitute agreement with 1 21 the explanation's substance by the members of the general assembly. 1 22 This bill provides that a city or county shall not adopt any 1 23 ordinance or regulation restricting access to the premises of 1 24 any wine or beer and liquor control licensed establishment to 1 25 any person 19 years of age or older.
