S.F. 2039 Section 1. NEW SECTION . 8H.1 Provision of menstrual 1 products. 2 1. The entity with authority over a state building shall 3 ensure that menstrual products are available, at no cost, in 4 the restrooms of the state building. 5 2. For the purpose of this section: 6 a. “Menstrual products” means tampons and period pads for 7 use in connection with the menstrual cycle. 8 b. “State agency” means a unit of state government, which 9 is an authority, board, commission, committee, council, 10 department, or independent agency as defined in section 7E.4, 11 including but not limited to each principal central department 12 enumerated in section 7E.5. However, “state agency” does not 13 mean any of the following: 14 (1) The office of the governor or the office of an elective 15 constitutional or statutory officer. 16 (2) The general assembly, or any office or unit under its 17 administrative authority. 18 (3) The judicial branch, as provided in section 602.1102. 19 (4) A political subdivision of the state or its offices or 20 units, including but not limited to a county or city, but not 21 including a community college. 22 c. “State building” means a public facility or building 23 owned, leased, or operated by or under the control of the 24 state government, a state agency, the state department of 25 transportation, the state board of regents, or the Iowa state 26 fair board. 27 Sec. 2. NEW SECTION . 218.101 Provision of menstrual 28 products. 29 Institutions controlled by the director of human services 30 as specified in section 218.1 shall make menstrual products 31 available, at no cost, to residents or patients of the 32 institutions in locations and as appropriate to the health 33 care needs of the residents or patients, and to staff and the 34 public, in the restrooms of the institutions. NEW SECTION . 270.4A Provision of menstrual 3 products. 4 The superintendent shall make menstrual products available, 5 at no cost, to students, staff, and the public in the restrooms 6 of school buildings and of each campus building frequented by 7 students, staff, and the public. As used in this section, 8 “menstrual products” means tampons and period pads for use in 9 connection with the menstrual cycle. 10 Sec. 4. NEW SECTION . 280.31 Provision of menstrual 11 products. 12 1. The board of directors of each public school district and 13 the authorities in charge of each nonpublic school shall ensure 14 that menstrual products are available, at no cost, to students, 15 staff, and the public in the restrooms of school buildings. 16 2. For the purposes of this section: 17 a. “Menstrual products” means tampons and period pads for 18 use in connection with the menstrual cycle. 19 b. “School building” means any facility that is owned or 20 leased by a public school district or nonpublic school over 21 which the board or authorities have care, custody, and control. 22 Sec. 5. NEW SECTION . 904.517 Provision of menstrual 23 products. 24 The department shall ensure that menstrual products 25 are available to offenders committed to the institutions 26 specified in section 904.102 at no cost and in a quantity and 27 as appropriate to the health care needs of the individual 28 offender. The department shall also ensure that menstrual 29 products are available, at no cost, for staff and the public in 30 the restrooms of the institutions. For the purposes of this 31 section, “menstrual products” means tampons and period pads for 32 use in connection with the menstrual cycle. 33 EXPLANATION 34 The inclusion of this explanation does not constitute agreement with 35 -2- LSB 5559XS (8) 88 pf/rh 2/ 3
S.F. 2039 the explanation’s substance by the members of the general assembly. 1 This bill requires menstrual products to be available at no 2 cost in certain buildings, institutions, and facilities under 3 the control of the state and in schools. 4 The bill requires that the entity with authority over a state 5 building shall ensure that menstrual products are available, at 6 no cost, in the restrooms of the state building. 7 The bill requires that institutions controlled by the 8 director of the department of human services make menstrual 9 products available, at no cost, to residents or patients of 10 the institutions in locations and as appropriate to the health 11 care needs of the residents or patients, and to staff and the 12 public, in the restrooms of the institutions. 13 The bill requires the superintendent of the school for the 14 deaf to make menstrual products available, at no cost, to 15 students, staff, and the public in the restrooms of school 16 buildings and of each campus building frequented by students, 17 staff, and the public. 18 The bill requires the board of directors of each public 19 school district and the authorities in charge of each nonpublic 20 school to ensure that menstrual products are available, at no 21 cost, to students, staff, and the public in the restrooms of 22 school buildings. 23 The bill requires that the department of corrections 24 ensure that menstrual products are available to offenders 25 committed to the institutions at no cost and in a quantity 26 and as appropriate to the health care needs of the individual 27 offender. The bill also requires the department of corrections 28 to ensure that menstrual products are available, at no cost, to 29 staff and the public, in the restrooms of institutions. 30 For the purposes of the bill, “menstrual products” means 31 tampons and period pads for use in connection with the 32 menstrual cycle. 33 -3- LSB 5559XS (8) 88 pf/rh 3/ 3
