Section
256.7,
subsection
7,
paragraph
b,
Code

Supplement
2011,
is
amended
to
read
as
follows:

b.
The
rules
shall
provide
that
when
the
curriculum
is
3
taught
by
an
appropriately
licensed
teacher
at
the
location
at
4
which
the
telecommunications
originates,
the
curriculum
shall
5
be
received
at
a
remote
site
shall
be
under
the
supervision
of
6
a
licensed
teacher
at
any
remote
site
.
The
licensed
teacher
at
7
the
originating
site
may
provide
supervision
of
students
at
a
8
remote
site
or
the
school
district
in
which
the
remote
site
is
9
located
may
provide
for
supervision
at
the
remote
site
if
the
10
school
district
deems
it
necessary
or
if
requested
to
do
so
by
11
the
licensed
teacher
at
the
originating
site.
For
the
purposes
12
of
this
subsection
,
“supervision”
:
13
(1)
“Supervision”
means
that
the
curriculum
is
monitored
by
14
a
proctor
who
need
not
be
a
licensed
teacher
and
the
teacher
15
is
but
shall
be
accessible
to
the
students
receiving
the
16
curriculum
by
means
of
telecommunications.

(2)
“Proctor”
means
a
school
librarian,
school
teacher,
18
school
administrator,
school
guidance
counselor,
teacher
19
assistant,
para-educator,
or
other
individuals
approved
by
the
20
department.

striking
the

the
subsection
and
inserting
in
lieu

the
following:

a.
At
the
discretion
of
the
board
of
directors
of
a

school
district
or
the
authorities
in
charge
of
a
school,

after
taking
into
consideration
necessity,
convenience,
and
29
cost-effectiveness,
brokered
courses
developed
by
outside
30
sources
may
be
approved
for
use
by
a
school
district
or
school.

Courses
used
by
a
school
district
or
school
in

accordance
with
paragraph
“a”
shall
be
taught
by
means
of
33
telecommunications
by
teachers
licensed
under
chapter
272;

however,
if
the
director
determines
special
circumstances

the
director
may
waive
this
requirement.

EXPLANATION
2
This
bill
directs
that
the
rules
adopted
by
the
state
3
board
of
education
for
the
use
of
telecommunications
as
an
4
instructional
tool
for
students
enrolled
in
kindergarten
5
through
grade
12
must
provide
that
when
the
curriculum
is
6
taught
by
an
appropriately
licensed
teacher
at
the
location
7
at
which
the
telecommunications
originates,
the
curriculum
8
shall
be
received
under
supervision
at
any
remote
site.
9
“Supervision”
is
defined
to
mean
that
the
curriculum
is
10
monitored
by
a
proctor
who
need
not
be
a
licensed
teacher,
but
11
shall
be
accessible
to
the
students
receiving
the
curriculum
by
12
means
of
telecommunications.
“Proctor”
is
defined
to
mean
a
13
school
librarian,
school
teacher,
school
administrator,
school
14
guidance
counselor,
teacher
assistant,
para-educator,
or
other
15
individual
approved
by
the
department.

Also,
at
the

board

a

courses

exist,
the
director
may
waive
this
requirement.

The
bill
eliminates
language
that
provides
that
26
telecommunications
shall
not
be
used
by
school
districts
as
27
the
exclusive
means
to
provide
any
course
which
is
required
28
by
the
minimum
educational
standards
for
accreditation,
and
29
a
provision
that
requires
the
state
board
to
establish
an
30
advisory
committee
to
make
recommendations
for
rules
on
the
use
31
of
telecommunications
as
an
instructional
tool.
