Senate File 2018 - Introduced SENATE FILE BY JOHNSON A BILL FOR 1 An Act relating to Iowa's urban renewal law by establishing 2 restrictions on the use of divided revenues and including 3 effective date provisions. 4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 5507XS (3) 86 md/sc PAG LIN 1 1 Section 1. Section 403.5, subsection 2, paragraph b, 1 2 subparagraph (1), Code 2016, is amended to read as follows: 1 3 (1) Prior to its approval of an urban renewal planwhich 1 4that provides for a division of revenue pursuant to section 1 5 403.19, the municipality shall mail the proposed plan by 1 6 regular mail to the affected taxing entities. The municipality 1 7 shall include with the proposed plan notification of a 1 8 consultation to be held between the municipality and affected 1 9 taxing entities prior to the public hearing on the urban 1 10 renewal plan. If the proposed urban renewal plan or proposed 1 11 urban renewal project within the urban renewal area, which 1 12 plan or project is approved prior to the effective date of 1 13 this Act, includes the use oftaxesrevenue resulting from a 1 14 division ofrevenuetaxes under section 403.19, subsection 2, 1 15 for a public building, including but not limited to a police 1 16 station, fire station, administration building, swimming 1 17 pool, hospital, library, recreational building, city hall, or 1 18 other public building that is exempt from taxation, including 1 19 the grounds of, and the erection, equipment, remodeling, 1 20 maintenance, repair, or reconstruction of, and additions or 1 21 extensions to, such a building, the municipality shall include 1 22 with the proposed plan notification an analysis of alternative 1 23 development options and funding for the urban renewal area or 1 24 urban renewal project and the reasons such options would be 1 25 less feasible than the proposed urban renewal plan or proposed 1 26 urban renewal project. A copy of the analysis required in this 1 27 subparagraph shall be included with the urban renewal report 1 28 required under section 331.403 or 384.22, as applicable, and 1 29 filed by December 1 following adoption of the urban renewal 1 30 plan or project. Urban renewal plans and urban renewal 1 31 projects approved on or after the effective date of this Act 1 32 shall not include the use of revenue resulting from a division 1 33 of taxes under section 403.19, subsection 2, for a public 1 34 building, including but not limited to a police station, fire 1 35 station, administration building, swimming pool, hospital, 2 1 library, recreational building, city hall, or other public 2 2 building that is exempt from taxation, including the grounds 2 3 of, and the erection, equipment, remodeling, maintenance, 2 4 repair, or reconstruction of, and additions or extensions to, 2 5 such a building. 2 6 Sec. 2. Section 403.12, subsection 1, paragraph f, Code 2 7 2016, is amended to read as follows: 2 8 f.CauseSubject to the limitation in section 403.5, 2 9 subsection 2, paragraph "b", subparagraph (1), cause public 2 10 buildings and public facilities, including parks, playgrounds, 2 11 and recreational, community, educational, water, sewer or 2 12 drainage facilities, or any other works which it is otherwise 2 13 empowered to undertake to be furnished; 2 14 Sec. 3. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 2 15 immediate importance, takes effect upon enactment. 2 16 EXPLANATION 2 17 The inclusion of this explanation does not constitute agreement with 2 18 the explanation's substance by the members of the general assembly. 2 19 This bill relates to Iowa's urban renewal law by providing 2 20 that urban renewal plans and urban renewal projects approved on 2 21 or after the effective date of the bill shall not include the 2 22 use of revenue resulting from a division of taxes for a public 2 23 building that is exempt from taxation, including the grounds 2 24 of, and the erection, equipment, remodeling, maintenance, 2 25 repair, or reconstruction of, and additions or extensions to, 2 26 such a building. The bill also modifies provisions governing 2 27 the use of such revenues for public buildings for plans and 2 28 projects approved before the effective date of the bill to 2 29 include the maintenance and repair of such public buildings. 2 30 The bill takes effect upon enactment.
