subsection
1,
paragraph
c,

subparagraph
(2),
Code
2024,
is
amended
by
adding
the
following

new
subparagraph
division:

DIVISION

(d)
For
a
member
who
was
a
4
licensed
teacher,
and
whose
first
month
of
entitlement
is
July
5
2024
or
later,
any
employment
with
a
covered
employer
and
6
covered
employment
does
not
include
employment
by
a
school
7
district
as
a
substitute
teacher.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
10
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
bona
fide
retirement
of
a
teacher
12
under
the
Iowa
public
employees’
retirement
system
(IPERS).
13
Current
law
provides
that
a
member
has
a
bona
fide
retirement
14
for
purposes
of
IPERS
when
the
member
does
not
return
to
15
any
employment
with
a
covered
employer
until
the
member
16
has
qualified
for
at
least
one
calendar
month
of
retirement
17
benefits,
and
the
member
does
not
return
to
covered
employment
18
until
the
member
has
qualified
for
no
fewer
than
four
calendar
19
months
of
retirement
benefits.
The
bill
establishes
that,
20
for
purposes
of
this
provision,
neither
any
employment
with
a
21
covered
employer
nor
covered
employment
include
employment
by
a
22
school
district
as
a
substitute
teacher.
