Section 272.31, Code 2015, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 3A. The board shall issue a classroom 1 4 driver education instructor authorization for purposes of 1 5 section 321.178 to a person who completes a training program 1 6 that meets the standards set by the board, who complies with 1 7 rules adopted pursuant to subsection 4, and who is either a 1 8 peace officer as defined in section 801.4, subsection 11, 1 9 paragraph "a", "b", "c", or "h", or is retired under chapter 97A 1 10 or 411, or section 97B.49B or 97B.49C, after service as a peace 1 11 officer as defined in section 801.4, subsection 11, paragraph 1 12 "a", "b", "c", or "h". The training program shall include 1 13 but not be limited to a minimum of fifteen contact hours in 1 14 a program consisting of instruction relating to classroom 1 15 management, strategies for learning, diversity, and ethics. 1 16 Sec. 2. Section 321.178, subsection 1, paragraph b, 1 17 subparagraph (1), Code 2015, is amended to read as follows: 1 18 (1) To be qualified as a classroom driver education 1 19 instructor, a person shallhave satisfied the educational 1 20 requirements for a teachingmeet one of the following 1 21 requirements: 1 22 (a) Hold a valid teacher's licenseat the elementary or 1 23 secondary levelandhold a valid licensean endorsement to 1 24 teach driver educationin the public schools of this state 1 25issued under chapter 272. 1 26 (b) Be a peace officer as defined in section 801.4, 1 27 subsection 11, paragraph "a", "b", "c", or "h", or be retired 1 28 under chapter 97A or 411, or section 97B.49B or 97B.49C, 1 29 after service as a peace officer as defined in section 801.4, 1 30 subsection 11, paragraph "a", "b", "c", or "h", and meet the 1 31 requirements of section 272.31, subsection 3A. 1 32 EXPLANATION 1 33 The inclusion of this explanation does not constitute agreement with 1 34 the explanation's substance by the members of the general assembly. 1 35 This bill permits a person who is a peace officer or a 2 1 retired peace officer to be qualified as a classroom driver 2 2 education instructor if the person also meets the board of 2 3 educational examiner's requirements for a classroom driver 2 4 education instructor authorization. Currently, only persons 2 5 holding a teaching license with an endorsement to teach driver 2 6 education may qualify to be a classroom driver education 2 7 instructor. 2 8 The bill directs the board of educational examiners to 2 9 issue a classroom driver education instructor authorization 2 10 to a person who completes a training program that meets the 2 11 standards set by the board and who is either a peace officer or 2 12 a retired peace officer. The training program shall include 2 13 but not be limited to a minimum of 15 contact hours in a program 2 14 consisting of instruction relating to classroom management, 2 15 strategies for learning, diversity, and ethics. 2 16 Under the bill, the term "peace officer" is limited to 2 17 sheriffs, deputy sheriffs, marshals and police officers of 2 18 cities, and peace officer members of the departments of public 2 19 safety and transportation.
