Senate File 165 - Introduced SENATE FILE BY ANDERSON and FEENSTRA A BILL FOR 1 An Act concerning the applicability of requirements for state 2 purchasing from prison industries for products manufactured 3 in this state. 4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 1561XS (3) 87 ec/nh PAG LIN 1 1 Section 1. Section 8A.311, Code 2017, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 12A. The director shall adopt rules which 1 4 provide that a department or agency is not required to comply 1 5 with the requirements of section 904.808 for the purchase of a 1 6 product if the department or agency can verify that the product 1 7 is manufactured within the state. 1 8 EXPLANATION 1 9 The inclusion of this explanation does not constitute agreement with 1 10 the explanation's substance by the members of the general assembly. 1 11 Code section 8A.311, concerning competitive bidding 1 12 procedures, is amended to provide that the director of the 1 13 department of administrative services (DAS) shall adopt rules 1 14 providing that DAS or any other state agency shall not be 1 15 required to comply with the requirements relating to purchasing 1 16 from prison industries if the product to be purchased is 1 17 manufactured in this state.
