Opening

1.
A
person
shall
not
open
a
door
on
a
vehicle
on
the
side

available
to
moving
traffic
unless
it
is
reasonably
safe
to
do

so
and
can
be
done
without
interfering
with
the
movement
of
5
such
traffic.
A
person
shall
not
leave
a
door
open
on
the
side
6
of
a
vehicle
available
to
moving
traffic
for
a
period
of
time
7
longer
than
necessary
to
load
or
unload
passengers.

2.
This
section
does
not
apply
to
a
member
of
a
public
9
safety
agency,
as
defined
in
section
34.1,
performing
official
10
duties.

A
person
convicted
of
a
violation
of
this
section
is
12
guilty
of
a
simple
misdemeanor
punishable
as
a
scheduled
13
violation
under
section
805.8A,
subsection
14,
paragraph
“m”
.

Sec.
2.
Section
805.8A,
subsection
14,
Code
2013,
is
amended
15
by
adding
the
following
new
paragraph:

.
m.
Open
vehicle
door
violations.
For
17
violations
under
section
321.362A,
the
scheduled
fine
is
one
18
hundred
dollars.

EXPLANATION
20
This
bill
adds
a
new
Code
section
that
prohibits
a
person
21
from
opening
a
door
on
the
side
of
a
vehicle
available
to
22
moving
traffic
unless
it
is
reasonably
safe
to
do
so
and
can
23
be
done
without
interfering
with
the
movement
of
traffic.
In
24
addition,
a
person
is
prohibited
from
leaving
a
door
open
on
25
the
side
of
a
vehicle
available
to
moving
traffic
for
longer
26
than
it
takes
to
load
or
unload
passengers.
The
new
provision
27
is
modeled
after
a
provision
in
the
uniform
vehicle
code
28
published
by
the
national
committee
on
uniform
traffic
laws
and
29
ordinances.

Members
of
public
safety
agencies
are
exempt
from
the
31
provisions
of
the
bill
when
performing
official
duties.
32
Pursuant
to
current
law,
a
functional
unit
of
a
public
agency
33
that
provides
fire
fighting,
law
enforcement,
ambulance,
34
medical,
or
other
emergency
services
is
a
“public
safety
