Senate File 147 - Introduced SENATE FILE BY CHAPMAN A BILL FOR 1 An Act relating to the confidentiality of personally 2 identifiable information of holders of nonprofessional 3 permits to carry weapons and permits to acquire pistols or 4 revolvers. 5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 1163XS (3) 87 jm/rj/rh PAG LIN 1 1 Section 1. Section 724.23, Code 2017, is amended to read as 1 2 follows: 1 3 724.23 Records kept by commissioner and issuing officers. 1 4 1. The commissioner of public safety shall maintain a 1 5 permanent record of all valid permits to carry weapons and of 1 6 current permit revocations. 1 7 2. a. The commissioner of public safety and any issuing 1 8 officer shall keep confidential any information that would 1 9 personally identify holders of nonprofessional permits to carry 1 10 weapons and permits to acquire pistols or revolvers, including 1 11 but not limited to the name, social security number, date of 1 12 birth, driver's license or other identification number, and 1 13 residential or business address of the permit holder, unless 1 14 such confidentiality is waived in writing by the permit holder. 1 15 b. This subsection shall not prohibit the release of 1 16 statistical information relating to the issuance, denial, 1 17 revocation, or administration of nonprofessional permits to 1 18 carry weapons and permits to acquire pistols or revolvers, 1 19 provided that the release of such information does not reveal 1 20 the identity of any individual permit holder. 1 21 c. This subsection shall not prohibit the release of 1 22 information to any law enforcement agency, or an employee 1 23 or agent thereof, when necessary for an investigation of 1 24 a possible violation of law or for conducting a lawfully 1 25 authorized background investigation. 1 26 EXPLANATION 1 27 The inclusion of this explanation does not constitute agreement with 1 28 the explanation's substance by the members of the general assembly. 1 29 Current law requires the commissioner of public safety 1 30 to maintain a permanent record of all valid permits to carry 1 31 weapons and of current permit revocations. The bill provides 1 32 that, notwithstanding any other law or rule to the contrary, 1 33 the commissioner of public safety and any issuing officer 1 34 (county sheriff) shall keep confidential any information that 1 35 would personally identify holders of nonprofessional permits 2 1 to carry weapons and permits to acquire pistols or revolvers, 2 2 including but not limited to the name, social security number, 2 3 date of birth, driver's license or other identification number, 2 4 and residential or business address of the permit holder 2 5 unless such confidentiality is waived in writing by the permit 2 6 holder. The bill does not prohibit the release of statistical 2 7 information relating to the issuance, denial, revocation, or 2 8 administration of nonprofessional permits to carry weapons and 2 9 permits to acquire pistols or revolvers if such information 2 10 does not reveal the identity of any individual permit holder, 2 11 or the release of information to any law enforcement agency, 2 12 or an employee or agent thereof, when necessary for an 2 13 investigation of a possible violation of law or for conducting 2 14 a lawfully authorized background investigation.
