Senate File 135 - Introduced SENATE FILE BY QUIRMBACH A BILL FOR 1 An Act relating to the compulsory age of attendance and to 2 sanctions for failure to attend school. 3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 1502XS (4) 87 kh/jh/rj PAG LIN 1 1 Section 1. Section 299.1A, subsection 1, Code 2017, is 1 2 amended to read as follows: 1 3 1. Except as provided in subsections 2 and 3, a child 1 4 who has reached the age of six and is undersixteeneighteen 1 5 years of age by September 15 is of compulsory attendance age. 1 6 However, if a child enrolled in a school district or accredited 1 7 nonpublic school reaches the age ofsixteeneighteen on or 1 8 after September 15, the child remains of compulsory age until 1 9 the end of the regular school calendar. 1 10 Sec. 2. STATE MANDATE FUNDING SPECIFIED. In accordance 1 11 with section 25B.2, subsection 3, the state cost of requiring 1 12 compliance with any state mandate included in this Act shall 1 13 be paid by a school district from state school foundation aid 1 14 received by the school district under section 257.16. This 1 15 specification of the payment of the state cost shall be deemed 1 16 to meet all of the state funding=related requirements of 1 17 section 25B.2, subsection 3, and no additional state funding 1 18 shall be necessary for the full implementation of this Act 1 19 by and enforcement of this Act against all affected school 1 20 districts. 1 21 EXPLANATION 1 22 The inclusion of this explanation does not constitute agreement with 1 23 the explanation's substance by the members of the general assembly. 1 24 This bill relates to compulsory attendance age of secondary 1 25 school students and sanctions for nonattendance. 1 26 The bill raises the compulsory school attendance age from 1 27 16 to 18, and therefore the driver's license sanctions of Code 1 28 section 299.1B apply to such a person. Under Code section 1 29 299.1B, a person who is of compulsory attendance age who does 1 30 not meet exception under Code section 299.2, does not attend 1 31 a public school or an accredited nonpublic school, is not 1 32 receiving competent private instruction or independent private 1 33 instruction, and who does not attend an alternative school or 1 34 adult education classes, shall not receive an intermediate or 1 35 full driver's license until age 18. 2 1 The bill may include a state mandate as defined in Code 2 2 section 25B.3. The bill requires that the state cost of 2 3 any state mandate included in the bill be paid by a school 2 4 district from state school foundation aid received by the 2 5 school district under Code section 257.16. The specification 2 6 is deemed to constitute state compliance with any state mandate 2 7 funding=related requirements of Code section 25B.2. The 2 8 inclusion of this specification is intended to reinstate the 2 9 requirement of political subdivisions to comply with any state 2 10 mandates included in the bill. LSB 1502XS (4) 87 kh/jh/rj
