Senate File 133 - Introduced SENATE FILE BY BOWMAN A BILL FOR 1 An Act providing for the promotion of micro=distilled spirits 2 made in Iowa and making an appropriation. 3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 1960XS (2) 87 ec/nh PAG LIN 1 1 Section 1. Section 15E.116, Code 2017, is amended to read 1 2 as follows: 1 3 15E.116 Iowa wine,andbeer, and spirits promotion board. 1 4 An Iowa wine,andbeer, and spirits promotion board is 1 5 created. The board consists ofthreefour members appointed 1 6 by the director of the economic development authority. Each 1 7 member shall serve a term of two years on the board. One member 1 8 shall represent the authority, one member shall represent the 1 9 Iowa wine makers,andone member shall represent the Iowa beer 1 10 makers, and one member shall represent the Iowa micro=distilled 1 11 spirits makers. The board shall advise the authority on the 1 12 best means to promote wine,andbeer, and spirits made in Iowa. 1 13 Sec. 2. Section 15E.117, Code 2017, is amended to read as 1 14 follows: 1 15 15E.117 Promotion of Iowa wine,andbeer, and spirits. 1 16 1. The economic development authority shall consult with 1 17 the Iowa wine,andbeer, and spirits promotion board on the 1 18 best means to promote wine,andbeer, and spirits made in Iowa. 1 19 2. The authority has the authority to contract with private 1 20 persons for the promotion of beer,andwine, spirits made in 1 21 Iowa. 1 22 3. Moneys appropriated to the authority pursuant to 1 23 sections 123.17, 123.143, and 123.183 may be used by the 1 24 authority for the purposes of this section, including 1 25 administrative expenses incurred under this section. 1 26 Sec. 3. Section 123.17, Code 2017, is amended by adding the 1 27 following new subsection: 1 28 NEW SUBSECTION. 5A. After any transfer provided for 1 29 in subsection 3 is made, there is appropriated from the 1 30 beer and liquor control fund to the economic development 1 31 authority for purposes of section 15E.117 a sum of moneys 1 32 equal to the markup, as determined pursuant to section 123.24, 1 33 on micro=distilled spirits sold by the division that are 1 34 manufactured in this state by a class "A" micro=distilled 1 35 spirits permittee which owns and operates a micro=distillery 2 1 located in Iowa. 2 2 Sec. 4. Section 123.17, subsection 6, Code 2017, is amended 2 3 to read as follows: 2 4 6. After any transfers or appropriations provided for in 2 5 subsections 3,and5, and 5A, the department of commerce shall 2 6 transfer to the division from the beer and liquor control 2 7 fund and before any other transfer to the general fund, an 2 8 amount sufficient to pay the costs incurred by the division for 2 9 collecting and properly disposing of the liquor containers. 2 10 EXPLANATION 2 11 The inclusion of this explanation does not constitute agreement with 2 12 the explanation's substance by the members of the general assembly. 2 13 This bill concerns the promotion of micro=distilled spirits 2 14 made in this state. 2 15 Code section 15E.116, establishing the Iowa wine and beer 2 16 promotion board, is amended to add spirits and rename the board 2 17 the Iowa wine, beer, and spirits promotion board. The bill 2 18 also adds an additional member to the board who represents Iowa 2 19 micro=distilled spirits makers. 2 20 Code section 15E.117, providing for the promotion of wine 2 21 and beer in Iowa, is amended by adding spirits. 2 22 Code section 123.17, concerning the beer and liquor control 2 23 fund, is amended by providing that a sum of moneys equal to 2 24 the markup on Iowa manufactured micro=distilled spirits sold 2 25 by the alcoholic beverages division shall be appropriated from 2 26 the beer and liquor control fund to the economic development 2 27 authority to be used for the promotion of Iowa wine, beer, and 2 28 spirits as provided in Code section 15E.117.
