  1  1    Section 1.  NEW SECTION.  135.191  Triclosan prohibition ==
  1  2 civil penalty.
  1  3    1.  A person shall not offer for retail sale in this state
  1  4 any cleaning product that contains triclosan and is intended
  1  5 to be used by the consumer for sanitizing or hand or body
  1  6 cleansing.
  1  7    2.  The prohibition in subsection 1 shall not apply to
  1  8 individual products for which specific United States food and
  1  9 drug administration approval for consumer use has been secured.
  1 10    3.  A person who violates this section is subject to a civil
  1 11 penalty of one thousand dollars for each violation.
  1 12    Sec. 2.  EFFECTIVE DATE.  This Act takes effect January 1,
  1 13 2019.
  1 14                           EXPLANATION
  1 15 The inclusion of this explanation does not constitute agreement with
  1 16 the explanation's substance by the members of the general assembly.
  1 17    This bill, beginning January 1, 2019, prohibits the retail
  1 18 sale of any cleaning product that contains triclosan and is
  1 19 intended to be used by the consumer for sanitizing or hand or
  1 20 body cleansing. The prohibition shall not apply to individual
  1 21 products for which specific United States food and drug
  1 22 administration approval for consumer use has been secured. The
  1 23 bill provides that a person who violates the bill is subject to
  1 24 a civil penalty of $1,000 for each violation.
