H.F. _____ Section 1. Section 321.194, subsection 2, paragraph a, Code 1 2023, is amended by adding the following new subparagraph: 2 NEW SUBPARAGRAPH . (04) (a) A licensee carrying proof 3 of authorization as provided in subparagraph division (b) 4 may operate a motor vehicle during the hours of 5:00 a.m. to 5 10:00 p.m. over the most direct and accessible route between 6 the licensee’s residence and the residence of any grandparent 7 of the licensee, provided the driving distance between the 8 licensee’s residence and the destination is no more than fifty 9 miles. 10 (b) The school board, superintendent, or principal of the 11 licensee’s school may authorize the licensee to operate a motor 12 vehicle pursuant to this subparagraph. If such authorization 13 is granted, the school board, superintendent, or principal, as 14 applicable, shall provide the licensee proof of authorization 15 on a form prescribed by the department. 16 Sec. 2. Section 321.194, subsection 2, paragraph a, 17 subparagraph (4), Code 2023, is amended to read as follows: 18 (4) To a service station for the purpose of refueling, so 19 long as the service station is the station closest to the route 20 on which the licensee is traveling under subparagraph (1), (2), 21 or (3) this paragraph . 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 Under current law, a person issued a special minor’s 26 driver’s license is generally allowed to operate a motor 27 vehicle during the hours of 5:00 a.m. to 10:00 p.m. between, 28 among other locations, the licensee’s residence, school of 29 enrollment, bus stops, certain other sites, facilities, or 30 schools for certain extracurricular activities, locations for 31 farm work, and fuel stations. 32 This bill authorizes a licensee to operate a motor vehicle 33 during the hours of 5:00 a.m. to 10:00 p.m. over the most 34 direct and accessible route between the licensee’s residence 35 -1- LSB 1485YC (2) 90 th/ns 1/ 2
H.F. _____ and the residence of any grandparent of the licensee, provided 1 the licensee is authorized to do so by the licensee’s school 2 board, superintendent, or principal, the licensee carries proof 3 of such authorization in the vehicle, and the driving distance 4 between the licensee’s residence and the destination is no more 5 than 50 miles. 6 If the school board, superintendent, or principal authorizes 7 the licensee in accordance with the bill, the school board, 8 superintendent, or principal, as applicable, is required to 9 provide the licensee with proof of authorization on a form 10 prescribed by the department of transportation. 11 A violation of Code section 321.194 is punishable by a 12 scheduled fine of $70. 13 -2- LSB 1485YC (2) 90 th/ns 2/ 2
