H.F. _____ Section 1. DEPARTMENT OF HUMAN SERVICES —— FOOD ASSISTANCE 1 —— MAXIMUM BENEFITS. The department of human services shall 2 amend its administrative rulers pursuant to chapter 17A 3 relating to categorical eligibility for food assistance 4 benefits to provide that a qualified household that includes 5 an individual under eighteen years of age, an individual 6 sixty-five years of age or older, a disabled individual as 7 defined by 42 U.S.C. §1382c, as amended, or an individual 8 enrolled in an eligible institution as defined in section 9 261.35, as at least a half-time student, as that term is 10 defined by rule of the college student aid commission, shall 11 qualify for the maximum benefit amount applicable to the 12 household’s size and gross monthly income limits under 7 U.S.C. 13 §2011 et seq. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill relates to qualifications for maximum benefit 18 amounts from the state food assistance program. 19 The bill provides that the department of human services 20 shall amend its administrative rules pursuant to Code chapter 21 17A relating to categorical eligibility for food assistance 22 benefits to provide that a qualified household that includes an 23 individual under 18 years of age, an individual 65 years of age 24 or older, a disabled individual as defined by federal social 25 security laws, or an individual enrolled in a postsecondary 26 educational institution which meets the requirements of the 27 provisions of the federal Higher Education Act of 1965 for 28 student participation in the federal interest subsidy program 29 and the requirements prescribed by rule of the college student 30 aid commission, as at least a half-time student, shall qualify 31 for the maximum benefit amount applicable to the household’s 32 size and gross monthly income limits as allowed under federal 33 law. 34 -1- LSB 6157YC (3) 89 dg/rh 1/ 1
