H.F. _____ Section 1. Section 714.2, subsection 3, Code 2020, is 1 amended to read as follows: 2 3. The theft of property exceeding seven hundred fifty 3 dollars but not exceeding one thousand five hundred dollars in 4 value, or the theft of any property not exceeding five seven 5 hundred fifty dollars in value by one who has before been twice 6 convicted of theft, is theft in the third degree. Theft in the 7 third degree is an aggravated misdemeanor. 8 Sec. 2. Section 902.12, subsection 3, Code 2020, is amended 9 to read as follows: 10 3. A person serving a sentence for a conviction for 11 robbery in the first degree in violation of section 711.2 12 for a conviction that occurs on or after July 1, 2018 2019 , 13 shall be denied parole or work release until the person has 14 served between one-half and seven-tenths of the maximum term 15 of the person’s sentence as determined under section 901.11, 16 subsection 3 . 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 Under current law, the theft of property that is more than 21 $750 but not more than $1,500, or the theft of any property 22 not more than $500 by a person who has previously been twice 23 convicted of theft, is theft in the third degree, an aggravated 24 misdemeanor. This bill increases the dollar amount limit for 25 the theft of any property by a person who has previously been 26 twice convicted of theft from $500 to $750. 27 Theft in the third degree is an aggravated misdemeanor 28 punishable by confinement for no more than two years and a fine 29 of at least $625 but not more than $6,250. 30 Under current law, a person serving a sentence for a 31 conviction of robbery in the first degree shall be denied 32 parole or work release until the person has served between 33 one-half and seven-tenths of the maximum term of the person’s 34 sentence, if the person was convicted on or after July 1, 2018. 35 -1- LSB 5074YC (1) 88 hf/rh 1/ 2
