Section
1.
Section
124.550,
Code
2018,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
3.
“Real-time”
refers
to
a
computer
system
3
that
updates
information
at
the
same
rate
as
it
receives
4
information.

Sec.
2.
Section
124.551,
subsection
3,
Code
2018,
is
amended
6
to
read
as
follows:

3.
The
board
shall
implement
technological
improvements
8
to
facilitate
secure
access
to
the
program
through
electronic
9
health
and
pharmacy
information
systems.
The
board
shall
10
ensure
that
information
submitted
to
the
program
pursuant
to
11
section
124.552,
subsection
1,
can
be
submitted
and
displayed
12
in
real
time.
The
board
shall
collect,
store,
and
disseminate
13
program
information
consistent
with
security
criteria
14
established
by
rule,
including
use
of
appropriate
encryption
or
15
other
industry-recognized
security
technology.

Sec.
3.
Section
124.552,
subsections
2
and
3,
Code
2018,
are
17
amended
to
read
as
follows:

2.
Information
shall
be
submitted
electronically
in
real
19
time
in
a
secure
format
specified
by
the
board
unless
the
board
20
has
granted
a
waiver
and
approved
an
alternate
secure
format.

3.
Information
shall
be
timely
transmitted
in
real
time
22
as
designated
by
the
board
and
advisory
council
by
rule,
23
unless
the
board
grants
an
extension.
The
board
may
grant
an
24
extension
if
either
of
the
following
occurs:
25
a.
The
pharmacy
suffers
a
mechanical
or
electronic
failure,
26
or
cannot
meet
the
deadline
established
by
the
board
for
other
27
reasons
beyond
the
pharmacy’s
control.

b.
The
board
is
unable
to
receive
electronic
submissions.

4.
Section
124.554,
subsection
1,
paragraph
b,
Code

2018,
is
amended
to
read
as
follows:

b.
An
electronic
real-time
format
for
the
submission
of

information
from
pharmacies.

Sec.
5.
EFFECTIVE
DATE.
This
Act
takes
effect
July
1,
2019.

This
bill
requires
the
board
of
pharmacy
to
implement
a

real-time
reporting
function
for
the
information
program
for

drug
prescribing
and
dispensing
by
January
1,
2019.
The
5
bill
also
requires
licensed
pharmacies
that
dispense
certain
6
controlled
substances
to
transmit
information
about
dispensed
7
prescriptions
to
the
program
in
real-time
by
January
1,
2019.
