equipment
used
primarily

excavation
when
moved
or
moving
upon
a
highway

that
is
not
a
portion
of
the
interstate.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

Code
section
321.453(1)
exempts
certain
motor
vehicles
and
9
equipment
from
most
provisions
of
Code
chapter
321
(motor
10
vehicles
and
law
of
the
road)
governing
size,
weight,
and
load,
11
and
the
permit
requirements
of
Code
chapter
321E
(vehicles
of
12
excessive
size
and
weight).
Such
motor
vehicles
and
equipment
13
include
fire
apparatus,
certain
road
maintenance
equipment,
14
implements
of
husbandry
when
moved
or
moving
upon
a
highway
15
that
is
not
a
portion
of
the
interstate,
and
certain
equipment
16
used
primarily
for
construction
of
permanent
conservation
17
practices
on
agricultural
land
when
moved
or
moving
upon
a
18
highway
that
is
not
a
portion
of
the
interstate.
This
bill
19
adds
hydroexcavation
equipment
used
primarily
for
digging
and
20
excavation
to
the
list
of
exempt
motor
vehicles
and
equipment,
21
when
such
vehicles
are
moved
or
moving
upon
a
highway
that
is
22
not
a
portion
of
the
interstate.

Motor
vehicles
and
equipment
listed
in
Code
section
24
321.453(1)
are
not
exempt
from
the
provisions
of
Code
section
25
321.463
(maximum
gross
weight),
321.471
(restrictions
by
local
26
authorities),
or
321.474
(restrictions
by
the
department
of
27
transportation),
which
include
a
number
of
weight
restrictions
28
and
certain
permit
provisions.

Under
Code
section
321.453(2),
exempted
implements
of
30
husbandry
and
agricultural
conservation
equipment
are
subject
31
to
additional
lighting,
warning
flag,
and
time-of-day
operation
32
requirements.
The
bill
does
not
add
hydroexcavation
equipment
33
to
this
provision.
