H.F. _____ Section 1. Section 477A.1, subsection 16, Code 2023, is 1 amended to read as follows: 2 16. “Video service” means video programming services 3 provided by a competitive video service provider through 4 wireline facilities located at least in part in the public 5 right-of-way without regard to delivery technology, including 6 internet protocol technology. “Video service” does not include 7 any video of the following: 8 a. Video programming provided by a provider of commercial 9 mobile service as defined in 47 U.S.C. §332 , or cable . 10 b. Cable service provided by an incumbent cable provider or 11 a competitive cable service provider or any . 12 c. Video programming provided by a provider of 13 direct-to-home satellite services as defined in 47 U.S.C. 14 §303(v). 15 d. Any video programming provided solely as part of, and 16 accessed via , a service that enables users to access content, 17 information, electronic mail, or other services offered over 18 the public internet , including digital audio-visual works . 19 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 20 importance, takes effect upon enactment. 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 This bill modifies the definition of “video service” 25 applicable to a competitive video service provider applying for 26 a certificate of franchise authority to provide cable and video 27 services. 28 The bill excludes video programming offered by a provider 29 of direct-to-home satellite services as video service.
