There is appropriated to the 1 department of administrative services for the fiscal year 2 beginning July 1, 2017, and ending June 30, 2018, from the 3 revolving funds designated in chapter 8A and from internal 4 service funds created by the department such amounts as the 5 department deems necessary for the operation of the department 6 consistent with the requirements of chapter 8A. 7 Sec. 3. STATE EMPLOYEE HEALTH INSURANCE ADMINISTRATION 8 CHARGE. For the fiscal year beginning July 1, 2017, and ending 9 June 30, 2018, the monthly per contract administrative charge 10 which may be assessed by the department of administrative 11 services shall be $2 per contract on all health insurance plans 12 administered by the department. 13 Sec. 4. AUDITOR OF STATE. 14 1. The department shall, in coordination with the health 10 facilities division, make the following information available 11 to the public as part of the department’s development efforts 12 to revise the department’s internet site: 13 (1) The number of inspections conducted by the division 14 annually by type of service provider and type of inspection. 15 (2) The total annual operations budget for the division, 16 including general fund appropriations and federal contract 17 dollars received by type of service provider inspected. 18 (3) The total number of full-time equivalent positions in 19 the division, to include the number of full-time equivalent 20 positions serving in a supervisory capacity, and serving as 21 surveyors, inspectors, or monitors in the field by type of 22 service provider inspected. 23 (4) Identification of state and federal survey trends, 24 cited regulations, the scope and severity of deficiencies 25 identified, and federal and state fines assessed and collected 26 concerning nursing and assisted living facilities and programs. 27 c. It is the intent of the general assembly that the 28 department and division continuously solicit input from 29 facilities regulated by the division to assess and improve 30 the division’s level of collaboration and to identify new 31 opportunities for cooperation. 32 5. The court appointed special advocate program shall 25 investigate and develop opportunities for expanding 26 fund-raising for the program. 27 d. Administrative costs charged by the department of 28 inspections and appeals for items funded under this subsection 29 shall not exceed 4 percent of the amount appropriated in this 30 subsection. 31 7. FTEs 28.50 2 8. APPROPRIATION REDUCTION —— REALLOCATION. The department 3 of inspections and appeals shall reduce appropriations made in 4 this section by $203,181. Notwithstanding section 8.39, the 5 department of inspections and appeals, in consultation with the 6 department of management, may reallocate moneys appropriated 7 in this section as necessary to best fulfill the needs of the 8 department provided for in the appropriation. However, the 9 department of inspections and appeals shall not reallocate 10 moneys appropriated to the department in this section unless 11 notice of the reallocation is given to the legislative services 12 agency prior to the effective date of the reallocation. The 13 notice shall include information regarding the rationale for 14 reallocating the moneys. The department of inspections and 15 appeals shall not reallocate moneys appropriated in this 16 section for the purpose of eliminating any program. 17 Sec. 13. DEPARTMENT OF INSPECTIONS AND APPEALS —— LICENSE OR 18 REGISTRATION FEES. 19 1. For the fiscal year beginning July 1, 2017, and ending 20 June 30, 2018, the department of inspections and appeals 21 shall collect any license or registration fees or electronic 22 transaction fees generated during the fiscal year as a result 23 of licensing and registration activities under chapters 99B, 24 137C, 137D, and 137F. 25 2. From the fees collected by the department under this 26 section on behalf of a municipal corporation with which 27 the department has an agreement pursuant to section 137F.3, 28 through a statewide electronic licensing system operated by 29 the department, notwithstanding section 137F.6, subsection 3, 30 the department shall remit the amount of those fees to the 31 municipal corporation for whom the fees were collected less 32 any electronic transaction fees collected by the department to 33 enable electronic payment. 34 3. From the fees collected by the department under this 4 section, other than those fees described in subsections 2 and 5 3, the department shall retain the remainder of the fees for 6 the purposes of enforcing the provisions of chapters 99B, 137C, 7 137D, and 137F. Notwithstanding section 8.39, the 18 department of inspections and appeals, in consultation with the 19 department of management, may reallocate moneys appropriated 20 in this section as necessary to best fulfill the needs of the 21 department provided for in the appropriation. However, the 22 department of inspections and appeals shall not reallocate 23 moneys appropriated to the department in this section unless 24 notice of the reallocation is given to the legislative services 25 agency prior to the effective date of the reallocation. The 26 notice shall include information regarding the rationale for 27 reallocating the moneys. The department of inspections and 28 appeals shall not reallocate moneys appropriated in this 29 section for the purpose of eliminating any program. 30 Sec. 40. DEPARTMENT OF INSPECTIONS AND APPEALS —— LICENSE OR 31 REGISTRATION FEES. 32 1. For the fiscal year beginning July 1, 2018, and ending 33 June 30, 2019, the department of inspections and appeals 34 shall collect any license or registration fees or electronic 35 -27- LSB 1046JB (3) 87 av/tm 27/ 37
S.F. _____ H.F. _____ transaction fees generated during the fiscal year as a result 1 of licensing and registration activities under chapters 99B, 2 137C, 137D, and 137F. 3 2. From the fees collected by the department under this 4 section on behalf of a municipal corporation with which 5 the department has an agreement pursuant to section 137F.3, 6 through a statewide electronic licensing system operated by 7 the department, notwithstanding section 137F.6, subsection 3, 8 the department shall remit the amount of those fees to the 9 municipal corporation for whom the fees were collected less 10 any electronic transaction fees collected by the department to 11 enable electronic payment. 12 3. From the fees collected by the department under this 13 section, other than those fees described in subsection 2, 14 the department shall deposit the amount of $400,000 into the 15 general fund of the state prior to June 30, 2019. 16 4. From the fees collected by the department under this 17 section, other than those fees described in subsections 2 and 18 3, the department shall retain the remainder of the fees for 19 the purposes of enforcing the provisions of chapters 99B, 137C, 20 137D, and 137F. Notwithstanding section 8.33, moneys retained 21 by the department pursuant to this subsection that remain 22 unencumbered or unobligated at the end of the fiscal year 23 shall not revert but shall remain available for expenditure 24 for the purposes of enforcing the provisions of chapters 99B, 25 137C, 137D, and 137F during the succeeding fiscal year. The 26 department shall provide an annual report to the department of 27 management and the legislative services agency on fees billed 28 and collected and expenditures from the moneys retained by 29 the department in a format as determined by the department 30 of management in consultation with the legislative services 31 agency. 32 Sec. 41. Section 10A.801, subsection 2, Code 2017, is 18 amended to read as follows: 19 2. The administrator shall coordinate the division’s 20 conduct of appeals and administrative hearings as provided 21 by law , shall serve as chief administrative law judge of the 22 division, and may conduct any proceeding for which the division 23 provides an administrative law judge . 24 Sec. 58. Section 10A.801, subsection 3, paragraph a, Code 25 2017, is amended to read as follows: 26 a. The department shall employ a sufficient number of 27 administrative law judges to conduct proceedings for which 28 agencies are required, by section 17A.11 or any other provision 29 of law, to use an administrative law judge employed by the 30 division. An administrative law judge employed by the division 31 shall not perform duties inconsistent with the judge’s duties 32 and responsibilities as an administrative law judge and shall 33 be located in an office that is separated from the offices of 34 the agencies for which that person acts as a presiding officer. 35 -34- LSB 1046JB (3) 87 av/tm 34/ 37

Section 10A.801, subsection 6, Code 2017, is 4 amended to read as follows: 5 6. After July 1, 1999, a A person shall not be newly 6 employed by the division as the administrator or as an 7 administrative law judge to preside over contested case 8 proceedings unless that person has a license to practice law 9 in this state. 10 CIGARETTES, CIGARS, OTHER TOBACCO PRODUCTS, AND ALTERNATIVE 11 NICOTINE PRODUCTS AND VAPOR PRODUCTS —— PERMITS 12 Sec. 60. Section 453A.13, subsection 2, paragraph c, Code 13 2017, is amended to read as follows: 14 c. The department, or a city or county, shall submit a 15 duplicate of any application for a retail permit and any 16 retail permit issued by the entity under this subsection to 17 the alcoholic beverages division of the department of commerce 18 within thirty days of the issuance. The alcoholic beverages 19 division of the department of commerce shall submit the current 20 list of all retail permits issued to the Iowa department of 21 public health by the first last day of each quarter of a state 22 fiscal year. 23 Sec. 61. Section 453A.47A, subsection 6, Code 2017, is 24 amended to read as follows: 25 6. Issuance. Cities shall issue retail permits to retailers 26 within their respective limits. County boards of supervisors 27 shall issue retail permits to retailers in their respective 28 counties, outside of the corporate limits of cities. The city 29 or county shall submit a duplicate of any application for 30 a retail permit and any retail permit issued by the entity 31 under this section to the alcoholic beverages division of the 32 department of commerce within thirty days of issuance. EFFECTIVE UPON ENACTMENT. The following 5 provision or provisions of this Act, being deemed of immediate 6 importance, take effect upon enactment: 7 1. The sections of this Act amending section 10A.801. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 DIVISION I —— FY 2017-2018. The bill makes appropriations to 15 state departments and agencies including the department of 16 administrative services, auditor of state, Iowa ethics and 17 campaign disclosure board, the office of the chief information 18 officer, department of commerce, offices of governor and 19 lieutenant governor, the governor’s office of drug control 20 policy, department of human rights, department of inspections 21 and appeals, department of management, Iowa public information 22 board, department of revenue, secretary of state, treasurer of 23 state, and Iowa public employees’ retirement system. 24 DIVISION II —— FY 2018-2019. The appropriation for 6 FY 2017-2018 shall not exceed $17,525, and the appropriation 7 for FY 2018-2019 shall not exceed $8,763. 8 DIVISION IV —— MISCELLANEOUS STATUTORY CHANGES. Code 9 section 10A.801 is amended to provide that the administrator of 10 the division of administrative hearings of the department of 11 inspections and appeals shall serve as the chief administrative 12 law judge of the division and may conduct any proceeding for 13 which the division provides an administrative law judge, is not 14 covered by the merit system, and must be licensed to practice 15 law in this state. 16 Code chapter 453A relating to cigarette and tobacco taxes 17 and regulation of alternative nicotine and vapor products is 18 amended to provide that a city or county that issues certain 19 retail permits related to the sale of such products is required 20 to submit a copy of the application for the retail permit to 21 the department of revenue upon issuance of the permit, but not 22 a copy of the permit itself, by the last, not the first, day of 23 each quarter of a state fiscal year. 24 DIVISION V —— EFFECTIVE DATE PROVISIONS.
