H.F. 7 Section 1. Section 321.234A, subsection 1, Code 2019, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . h. The all-terrain vehicle is an off-road 3 utility vehicle operated on a primary road in accordance with 4 section 321I.10, subsection 6. 5 Sec. 2. Section 321.234A, subsection 2, Code 2019, is 6 amended to read as follows: 7 2. A person operating an all-terrain vehicle on a highway 8 shall have a valid driver’s license and the vehicle shall be 9 operated at speeds of thirty-five miles per hour or less. The 10 speed limit in this subsection shall not apply to a person 11 operating an off-road utility vehicle on a primary road in 12 accordance with section 321I.10, subsection 6. 13 Sec. 3. Section 321I.10, Code 2019, is amended by adding the 14 following new subsection: 15 NEW SUBSECTION . 6. An off-road utility vehicle may be 16 operated on a primary road if the off-road utility vehicle is 17 equipped with a bicycle safety flag and is operated at speeds 18 of forty-five miles per hour or less only from sunrise to 19 sunset. For purposes of this paragraph, “primary road” means 20 the same as defined in section 306.3, except that it does not 21 include an interstate road. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 This bill relates to the operation of off-road utility 26 vehicles on certain primary roads and makes certain penalties 27 applicable. 28 Currently, Code sections 321.234A (all-terrain vehicles —— 29 highway use) and 321I.10 (all-terrain vehicle operation on 30 roadways, highways, and trails) prohibit the operation of an 31 off-road utility vehicle on primary roads subject to certain 32 exceptions. 33 Under Code section 321.234A(2), a person operating an 34 off-road utility vehicle on any highway is required to have 35 -1- LSB 1088YH (6) 88 mo/rh 1/ 2
H.F. 7 a valid driver’s license and to operate the off-road utility 1 vehicle at speeds of 35 miles per hour or less. The bill 2 provides that this speed limitation does not apply to a person 3 operating an off-road utility vehicle on a primary road if the 4 vehicle is equipped with a bicycle safety flag and is operated 5 at speeds of 45 miles per hour or less from sunrise to sunset. 6 A person who operates an off-road utility vehicle in 7 violation of the provisions of the bill is subject to 8 scheduled fines of $50 pursuant to Code sections 805.8A(3) and 9 805.8B(2A)(b)(2). 10 -2- LSB 1088YH (6) 88 mo/rh 2/ 2
