  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 139A.8, subsection 4, paragraph a,
  1  2 unnumbered paragraph 1, Code 2017, is amended to read as
  1  3 follows:
  1  4    Immunization is not required for a person's enrollment
  1  5 in any elementary or secondary school or licensed child care
  1  6 center if either any of the following applies:
  1  7    Sec. 2.  Section 139A.8, subsection 4, paragraph a, Code
  1  8 2017, is amended by adding the following new subparagraph:
  1  9    NEW SUBPARAGRAPH.  (3)  The applicant, or if the applicant
  1 10 is a minor, the applicant's parent or legal guardian, submits
  1 11 an affidavit signed by the applicant, or if the applicant is
  1 12 a minor, the applicant's parent or legal guardian, stating
  1 13 that the applicant opposes the immunizations on the basis of
  1 14 personal conviction.
  1 15                           EXPLANATION
  1 16 The inclusion of this explanation does not constitute agreement with
  1 17 the explanation's substance by the members of the general assembly.
  1 18    This bill provides that, in addition to other bases for
  1 19 exemption from required immunizations for a person's enrollment
  1 20 in any elementary or secondary school or licensed child care
  1 21 center, the applicant is also exempt if the applicant, or if
  1 22 the applicant is a minor, the applicant's parent or legal
  1 23 guardian, submits an affidavit signed by the applicant, or
  1 24 if the applicant is a minor, the applicant's parent or legal
  1 25 guardian, stating that the applicant opposes the immunization
  1 26 on the basis of personal conviction.
