H.F. 684 Section 1. Section 479B.9, Code 2023, is amended to read as 1 follows: 2 479B.9 Final order —— condition. 3 The board may grant a permit , subject to section 479B.34, in 4 whole or in part upon terms, conditions, and restrictions as to 5 location and route as it determines to be just and proper. A 6 permit shall not be granted to a pipeline company unless the 7 board determines that the proposed services will promote the 8 public convenience and necessity. 9 Sec. 2. NEW SECTION . 479B.34 Contested case proceeding. 10 A pipeline company shall be required to prove to the board 11 in a contested case proceeding subject to chapter 17A that 12 there is no less costly, less burdensome, or more efficient 13 alternative to sequester carbon dioxide than the pipeline 14 company’s application for a permit. 15 Sec. 3. IOWA GEOLOGICAL SURVEY. There is appropriated from 16 the federal Coronavirus State and Local Fiscal Recovery Funds, 17 31 C.F.R. §35, to the Iowa geological survey created in section 18 456.1 for the fiscal year beginning July 1, 2023, and ending 19 June 30, 2024, the following amount, or so much thereof as is 20 necessary, to be used for the purposes designated: 21 For the assessment of the geological capacity and 22 feasibility of sequestering industrial carbon emissions in the 23 state: 24 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 12,500,000 25 The Iowa geological survey shall submit quarterly reports to 26 the department of natural resources, the department of economic 27 development, and members of the general assembly, regarding 28 carbon dioxide sequestration and shall submit a final report 29 by June 30, 2024. 30 Notwithstanding section 8.33, moneys appropriated in this 31 section that remain unencumbered or unobligated at the close of 32 the fiscal year shall not revert but shall remain available for 33 expenditure for the purposes designated until the close of the 34 succeeding fiscal year. 35 -1- LSB 2208YH (3) 90 es/rn 1/ 3
H.F. 684 Sec. 4. ECONOMIC DEVELOPMENT AUTHORITY. There is 1 appropriated from the federal Coronavirus State and Local 2 Fiscal Recovery Funds, 31 C.F.R. §35, to the Iowa economic 3 development authority for the fiscal year beginning July 1, 4 2023, and ending June 30, 2024, the following amount, or so 5 much thereof as is necessary, to be used for the purposes 6 designated: 7 For the support of the office of the governor’s carbon 8 sequestration task force upon a positive feasibility report 9 from the Iowa geological survey, to prepare for and facilitate 10 the capture and sequestration of carbon dioxide in the 11 state by industrial carbon emitters subject to regulation 12 by the department of natural resources in consultation and 13 coordination with stakeholders: 14 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 250,000 15 Notwithstanding section 8.33, moneys appropriated in this 16 section that remain unencumbered or unobligated at the close of 17 the fiscal year shall not revert but shall remain available for 18 expenditure for the purposes designated until the close of the 19 succeeding fiscal year. 20 Sec. 5. EFFECTIVE DATE. This Act, being deemed of immediate 21 importance, takes effect upon enactment. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 This bill relates to carbon dioxide sequestration. 26 The bill requires a pipeline company to prove that there is 27 no less costly, less burdensome, or more efficient alternative 28 to sequester carbon dioxide than the pipeline company’s 29 application for a permit in a contested case proceeding 30 pursuant to Code chapter 17A. 31 The bill makes an appropriation to the Iowa geological 32 survey to assess the geological capacity and feasibility of 33 sequestering industrial carbon emissions in the state.
