H.F. 682 Section 1. NEW SECTION . 80.47 Public safety equipment fund. 1 1. A public safety equipment fund is created in the state 2 treasury under the control of the department. The fund shall 3 consist of moneys remitted by the county treasurer of a county 4 or by the department of transportation which were collected 5 through the payment of a contribution made by an applicant for 6 motor vehicle registration renewal pursuant to section 321.44B 7 and any other moneys appropriated to or deposited in the fund. 8 Moneys in the fund are appropriated to the department for the 9 purchase, maintenance, and replacement of equipment used by the 10 department. 11 2. Notwithstanding section 8.33, moneys in the fund 12 that remain unencumbered or unobligated at the close of a 13 fiscal year shall not revert but shall remain available for 14 expenditure for the purposes designated. Notwithstanding 15 section 12C.7, subsection 2, interest or earnings on moneys in 16 the fund shall be credited to the fund. 17 Sec. 2. NEW SECTION . 321.44B Voluntary contribution 18 —— public safety equipment fund —— amount retained by county 19 treasurer. 20 For each application for registration renewal, the county 21 treasurer or the department shall request through use of a 22 written form, and, if the application is made in person, 23 through verbal communication, that an applicant make a 24 voluntary contribution of one dollar or more, computed to the 25 nearest whole dollar, to the public safety equipment fund 26 established pursuant to section 80.47. One hundred percent 27 of the moneys collected by the county and one hundred percent 28 of the moneys collected by the department in the form of 29 contributions shall be remitted to the treasurer of state for 30 deposit in the public safety equipment fund to be used for the 31 purposes specified for the fund. However, up to five percent 32 of the moneys collected by the county may be retained by the 33 county treasurer for deposit in the general fund of the county. 34 The director shall adopt rules to administer this section. 35 -1- LSB 2433HV (2) 88 ns/rh 1/ 2
H.F. 682 Sec. 3. Section 331.557, subsection 1, Code 2019, is amended 1 to read as follows: 2 1. Issue, renew, and replace lost or damaged vehicle 3 registration cards or plates , and issue and transfer 4 certificates of title for vehicles , and collect voluntary 5 contributions, as provided in sections 321.17 to through 6 321.52 . 7 Sec. 4. EFFECTIVE DATE. This Act takes effect January 1, 8 2020. 9 EXPLANATION 10 The inclusion of this explanation does not constitute agreement with 11 the explanation’s substance by the members of the general assembly. 12 This bill creates a public safety equipment fund and 13 appropriates moneys in the fund to the department of public 14 safety for the purchase, maintenance, and replacement of 15 equipment used by the department. The bill provides that for 16 each application for motor vehicle registration renewal, the 17 county treasurer or the department of transportation (DOT) 18 shall request through use of a written form, and, if the 19 application is made in person, through verbal communication, 20 that an applicant make a voluntary contribution of $1 or more, 21 computed to the nearest whole dollar, to the public safety 22 equipment fund. The moneys collected by the county and the DOT 23 in the form of contributions must be remitted to the treasurer 24 of state for deposit in the public safety equipment fund. 25 However, up to 5 percent of the moneys collected by the county 26 may be retained by the county treasurer for deposit in the 27 general fund of the county. 28 The bill takes effect January 1, 2020. 29 -2- LSB 2433HV (2) 88 ns/rh 2/ 2
