  1 An Act relating to the distribution of fines imposed by the
  2    automated enforcement of traffic laws.
  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 321.1, Code 2015, is amended by adding
  1  2 the following new subsections:
  1  3    NEW SUBSECTION.  06A.  "Automated traffic law enforcement
  1  4 system" means a device with one or more sensors working in
  1  5 conjunction with one of the following:
  1  6    a.  An official traffic=control signal, to produce recorded
  1  7 images of motor vehicles entering an intersection against a red
  1  8 signal light.
  1  9    b.  A speed measuring device, to produce recorded images of
  1 10 motor vehicles traveling at a prohibited rate of speed.
  1 11    c.  A railroad grade crossing signal light, as described in
  1 12 section 321.342, to produce images of vehicles violating the
  1 13 signal light.
  1 14    d.  Any official traffic=control device, if failure to comply
  1 15 with the official traffic=control device constitutes a moving
  1 16 violation under this chapter.
  1 17    NEW SUBSECTION.  006A.  "Automated traffic law enforcement
  1 18 system vendor" means a person who provides or proposes to
  1 19 provide services related to the installation, maintenance,
  1 20 or operation of an automated traffic law enforcement system
  1 21 pursuant to a contract with a local authority.
  1 22    Sec. 2.  NEW SECTION.  321.260A  Automated traffic law
  1 23 enforcement ==== notice of fine distribution on citation.
  1 24    If a local authority issues a citation as a result of an
  1 25 image or any other indication of activity obtained from an
  1 26 automated traffic law enforcement system, the citation shall
  1 27 provide an itemized list of the fines and fees assessed
  1 28 pursuant to the citation, the name of each automated traffic
  1 29 law enforcement system vendor that will receive a portion of
  1 30 the fines or fees, the amount of the fines or fees retained
  1 31 by the local authority, and the amount of the fines or fees
  1 32 that each automated traffic law enforcement system vendor will
  1 33 receive.
